No state official of Hawaii has certified by affidavit, (Fukino has not) Obama’s birth there or by corroborating evidence by any hospital, doctor, midwife or a single witness to his birth. Hawaii does have a legal sworn affidavit by Timothy Adams dated January 20, 2011stating: “8. During the course of my employment, I was told by senior officers in the City and County of Honolulu Elections Division to stop inquiring about Senator Obama's Hawaii birth records, even though it was common knowledge among my fellow employees that no Hawaii long-form, hospital-generated birth certificate existed for Senator Obama.”


Thus, it is criminal act for prosecution by a proper Attorney General of anyone and that includes all freaks and traitors who knowingly help in officiating Obama’s run for office to be a U.S. President, disseminating false or misleading information. In general: basically you report the crime or you are guilty of the same crime, if you aid or abet in his criminal act against the U. S. of America under 18 U.S.C. s2.

Adams' statement is hearsay, which is a fancy legal word for gossip, and thus inadmissible.

On the other hand, (a paper version of) President Obama's COLB is valid and sufficient evidence for any court in the United States.

Honolulu city clerk debunks new 'birther' theory

Over the past few weeks, a Kentucky resident and teacher named Timothy Adams has made the rounds online and on talk radio with an extraordinary claim -- he was the "senior elections clerk" for Honolulu in 2008, where it was an open secret that the city and state had no proof of Barack Obama's citizenship. As he told WorldNetDaily, the racing form for birtherism:

I had direct access to the Social Security database, the national crime computer, state driver's license information, international passport information, basically just about anything you can imagine to get someone's identity. I could look up what bank your home mortgage was in. I was informed by my boss that we did not have a birth record [for Barack Obama].

I checked with Glen Takahashi, the administrator of the Honolulu City Clerk's office, and while he verified that Adams worked there, he explained – gently making it clear he did not want to "call anyone a liar" -- that Adams never actually had access to information about Barack Obama.

"Our office does not have access to birth records," Takahashi said. "That's handled by the state of Hawaii Department of Health. Where he's getting that, I don't know. Put it this way: Barack Obama was not trying to register to vote in Hawaii. He is, as far as I know, not a registered voter here. So no one was looking that up."

Takahashi explained that the "senior elections clerk" job that Adams held was a low-level data entry position dealing with voter registration and absentee ballots -- Adams was one of dozens of temporary employees who staffed the pre-election rush. And he contradicted Adams's claims that Obama's lack of a birth certificate was an "open secret" or that voters contacted the office to ask about it.

"To be honest, I fielded no questions about that," Takahashi said. "Why would anyone ask us? We don't have those records."

The internal contradictions of Adams's story haven't stopped him from expanding his media presence this week, most recently with a local TV interview in which he repeated his claims (some of them based on popular "birther" rumors from the Web) while, confusingly, stating that he didn't think Obama's eligibility was an issue.

A state issued, certified birth certificate with a state Seal and Registrar's signature is a self-authenticating document under Federal Rule of Evidence 902.

No affidavit or corroboration is needed for a self-authenticating document and the Full Faith and Credit Clause of the Constitution (Article IV, Section 1) says that whatever the state of Hawaii says is a valid birth record of their state will be accepted in every other state and by the federal government.

If Takahashi testified in court in a manner consistent with what he said in the newspaper article, that would not be hearsay, as he's not repeating what anyone else said.

If Adams testified in court about what some unnamed person allegedly told him, that would be hearsay.

And notice how Adams still has not named his mystery source in the Hawaii Department of Elections (or that person's source in the Department of Health).

Too bad the usurper's short-form "Certification of Live Birth" is not prima-facie evidence for the Hawaii Department of Home Lands and possible "abstract" (according to the Hawaii State Registrar's stamp on it) long-form "Certificate of Live Birth" would not be prima-facie evidence for the U.S. State Department Passport Office.

The Hawaii Department of Health requires the official Seal of the Department of Health to be embossed on a birth certificate as authentication thereof.

Obama's alleged authentic Hawaii short-form and long-form "birth certificates" do not have a visable, much less legible, official seal of the HDOH embossed on them. NO SEAL = NOT REAL
