Unless the motion to dismiss has been denied, there is no way Klayman can be in "discovery". According to Orly, this case is in it's early stages and I don't think the other side has even responded yet. I am skepitcal of Klayman,

The docket still does not show a return of service. This does not necessarily mean the defendants have not been served.
No Motion to Dismiss appears on the docket, so I don't know where you got anything about a motion to dismiss being filed.
Depending on the rules of procedure in FL initial discovery "could" be in process, regardless, but I'm certainly still skeptical, based on his prior assertion then changing it when called out form "in discovery" to "preparing discovery."
When I see discovery... interrogatories, requests for production, subpoenas, notices of deposition and the like, I'll believe he's "in discovery." Until then...

Isn't this just about the time he stole Harrison J. Bounel's SS#? I remember reading that he took over Bounel's SS# in the late 70's after the guy died, but didn't start using it till the early 80's. The mailman said the Ayers family was helping foreign student Barry Soetoro with his education. Didn't they also have contacts at Columbia at that time? I'm pretty sure Tom Ayers did. So The Weather Underground gets a new SS# for Barry and Barack/Baraka is born. At least, that's the way I see it.

It was "Barack Obama" who graduated from the Punahou School in Honolulu although his friends called him "Barry" Obama, not Soetoro. He was on the high school basketball team which won the state championship with the last name "Obama."

I thought Barry had a 099 prefix SS# (or is it 990/999?) at Occidental? Isn't that the prefix given to foreign students?
Barry Soetoro might have been at Punahao as Barry Obama, using the name he was born with, BUT he might not have had it legally changed from Soetoro at the time. That's if it was ever legally changed back to Obama. So his first SS# might have legally been under Soetoro even though he used the Obama surname as a teen. He started using Bounel's SS# in the early 80's, IIRC, even though he assumed it in the late 70's after Bounel died. This all probably goes back to the Ayers family and the mailman's story about how he was introduced to Barry the foreign student.

2. The name of the case is State v. Bari Shabazz which was a non-jury case. The case is characterized as a “Traffic Crime,” with a “REPORT number W50100.” The offense occurred on March 12, 1982. The charging police officer is Duane Masayuki Espinueva. The event is characterized as an “Accident Major.” The charge was driving without a valid driver’s license.

The report then shows that the prosecutor on April 9, 2003, filed an ex parte motion to recall the bench warrant and announced on the record “nolle prosequi.” This is a Latin phrase which is formally entered into a court record which means that the prosecutor in a criminal case “will no further prosecute” the case.
9. The motion was listed as “NP [nolle prosequi] 040903.” So, the charge was dismissed upon the prosecutor’s ex parte “Nolle Prosequi” motion made on April 9, 2003. “Ex parte” means that only one side made the application which in this case was the prosecutor.
10. The final entry was for October 30, 2005, at 8:00 a.m., when the court noted that a $-0- balance was owed, but said “Pls check.”
11.The accident is characterized as a major accident. Chances are that Bari Shabazz and/or any passenger was taken to a local hospital in Honolulu County due to his/their injuries. If Bari Shabazz suffered any major injuries or laceration, the physical signs of those injuries and/or lacerations could still be present somewhere on his body if he is still alive.

i bet the shabazz accident is a dead end. you will find that the players are dead, cant be found or wont remember anything about it. She should focus on following proper procedures and rules in her own cases. Just look at her continual fuckups in Mississippi.

But it cannot be denied that she is working the HARDEST .... for the LONGEST TIME (for the Constitution and our benefit).
Every state has different court rules, even worse - much worse, every court has different "local" rules which often overide the state rules.
It is also TRUE that all courts (and individual judges) have wide latitude to waive the rules because NO LAWYER is smart enough to know "all" the rules, (especially if an out-of-state/area lawyer).
I repeat NO LAWYER is smart enough to know ALL the rules, (and "local" rules that override them).
It is also TRUE that there are always SEVERAL legal arguments that can/could be used and very seldom do "all" lawyers agree on methods, (hence you often have several lawyers working on the same case cause all may have a different point-of-view).
Therefore all attacks on Orly have been Monday-Morning-Quarterbacking reflection different POV's.
And yes, Orly has "failed", but so have ALL OTHER ATTORNEYS as judges have consistently ruled against them also.

As you can see, discovery in FL may even be included with the initial service of process of the initial pleading. That is the case in many jurisdictions.

Yes, but her constant unwillingness to take clues (e.g. as to how to properly serve the defendant or how to properly amend motions and argue them) is detrimental. Good will alone isn't enough. "A for effort" isn't either.

Orly's problem is that she doesn't just fail on some far-out local rules that "nobody knows" but on the most elementary things that are the same everywhere - as in "to apply for pro hac vice, you need a local attorney sponsoring your application".
And of course courts don't give any leeway to her in that regard.
