Here's the deal...
Many legal analysts and scholars agree with this take-- and until the Supreme Court weighs in.. this is how the law is interpreted:The Constitution requires that the president be a "natural born citizen," but does not define the term. That job is left to federal law, in 8 U.S. Code, Section 1401. All the law requires is that the mother be an American citizen who has lived in the U.S. for five years or more, at least two of those years after the age of 14. If the mother fits those criteria, the child is a U.S. citizen at birth, regardless of the father's nationality.
The brouhaha over President Obama's birth certificate -- has revealed a widespread ignorance of some of the basics of American citizenship. The Constitution, of course, requires that a president be a "natural born citizen," but the Founding Fathers did not define the term, and it appears few people know what it means.
The law lists several categories of people who are considered American citizens at birth. There are the people born inside the United States; no question there. There are the people who are born outside the United States to parents who are both citizens, provided one of them has lived in the U.S. for any period of time. There are the people who are born outside the United States to one parent who is a U.S. citizen and the other who is a U.S. national (that is, from an outlying possession of the U.S.), provided the citizen parent has lived in the United States or its possessions for at least one year prior to the birth of the child. And then there are the people who are born outside the United States to one parent who is a U.S. citizen and the other who is an alien, provided the citizen parent lived in the United States or its possessions for at least five years, two of them after the age of 14.
They're all natural born U.S. citizens. That also includes people who are born in Puerto Rico and people who were born in states before they became states. Born in Hawaii in 1950, a decade before statehood? You're a natural born U.S. citizen.
That is how legal experts interpret the "natural born" requirement.. and how you get that status is actually pretty open. Until the Supreme Court weighs in on this issue (and there are no plans that we know of that that will happen)... -- to your emails... Senator Marco Rubio and Governor Bobby Jindal are both eligible to run and become Vice President or President.

Note to Katy and Bret: The United States Constitution is not a Dictionary. The Fourteenth Amendment did not amend Article II nor did it change what a "natural born Citizen" is. Nor does it mention "natural born Citizen" in it. Why cite 8 USC § 1401?

As far as I know, The INNA of 1986 was not retroactive. Obama was born August 04, 1961, so the residency requirement of "ten years, including 5 after the age of 14" applies. Obama's mother was only age 18 when he was born. Shy by 3 months.

This is just completely wrong. The material the author cites describe the citizenship requirements for a child born outside the geographical limits of the U.S. See:

Moreover, the law the author cites never uses the term "natural-born citizen" but instead refers to "Nationals and citizens of United States at birth." What's worse, the law makes no mention of needing two citizen parents to be considered a natural-born citizen.

Except that it isn't proven. There is one sheriff who thinks so, but has thus far failed to get it in court. Moreover, this same sheriff has just been smacked a bit by an Ethics Panel in Arizona for doing just this: holding press conferences with no real evidence to support the claims he is making.

Justice Gray does a very revealing compare and contrast here:
- he compares two children
- on the one hand, he mentions the US born child of a resident alien
- on the other hand, he mentions the “natural-born” child of a citizen
Justice Gray clearly states that only one is natural-born: the child of the citizen.
It's been said, "evil will flourish if good men remain silent". Or something like that but it is correct.
In order to believe what was said by Brett, you have to deny the rules of legal construction. That being, you cannot change or alter a law without directly referencing that law.
This means, the Immigration and Naturalization Laws Brett is citing would have to directly mention the very specific requirements for president. They do not.
When the Constitution was drafted The Law of Nations and the principals spelled out by Vattel was the accepted definition of Natural Born and the video by Mr. Titus is as good as it gets in my view.

Anonymous @4:21: You miss the point. The dissenting opinion discusses the fact that if the majority is correct, any foreigner who is passing through the U.S. can have a baby in this country who could then grow up to be President. His argument was rejected.

Fellas, look, I don't have the training or smarts to determine who is a natural born citizen. I leave that up to the experts. I was only pointing out that the article was incorrectly citing a federal law, and that law, 8 U.S. Code, Section 1401, says nothing about requiring two citizen parents.
In the past couple of weeks, several article have appeared that had obvious errors in fact, for example, Mr. Klayman saying he was "in discovery" or The Daily Pen saying that Nobama's attorney said something that she didn't say. Since I respect what the people who run this website are doing, I was urging them not to post an article without checking them for accuracy.

It's you who seems incapable of understanding.
What he's stating is that he finds it unreasonable (thus he's dissenting/disagreeing with the majority opinion) which states that your 1 and 2 are eligible to be president.
Put another way... he's clearly stating that the majority opinion provides that those born on soil, regardless of the situation of their parents, their race, color, etc., are natural born citizens and eligible to be president.
He's affirming that the majority opinion clearly states that's so, and he's disagreeing with the majority.
The majority opinion, however, stands.

“If the government can just order you to buy something, and fine you if you don’t” – the way the individual mandate of Obamacare requires every American to buy government-approved health insurance and fines them if they don’t comply – “they can order you to do anything,” Virginia Attorney General Ken Cuccinelli said during an appearance on C-SPAN’s “Newsmaker” on Sunday.
Cuccinelli, the first attorney general to file a lawsuit challenging Obamacare, said out of 16 judges that have heard the lawsuit so far, only one has ruled that the fine amounts to a tax."

“The centerpiece constitutional issue is the individual mandate – the requirement in the health care bill that every American buy government-approved health insurance, and this is done under the Commerce Clause. It is commonly talked about as the 10th Amendment – it is not a 10th Amendment case,” Cuccinelli said.
The question at hand, he said, is whether Congress’ power to regulate interstate commerce allows them “compel you to buy health insurance.”
“And our side obviously says, No. The federal government says, ‘Yes.’ And there has never been a case like this ever before in the over 200 years since the Constitution was passed. The federal government has never compelled people to buy a product under the guise of regulating commerce,” Cuccinnell added.
He said when they filed their case against Obamacare on March 23, 2010, “it was all about the Commerce clause,” and the critics predicted that the federal government would win, “but as we just kept making our case – and ‘we’ here is all of the states that address the limited government side of this that said this is too much power for the federal government. As we just kept making the case, kept making the case, gradually, it became clear the other side began to get worried that they could lose.”
