That also would have triggered the newspaper announcements as they were produced from a list sent by the Hawaii DOH, not the Hospital or the parents/grandparents.

As for O'Reilly's claim Sheriff Joe provided no evidence. That is an outright lie and anyone that watches the complete press conference can see that. Notice how O'Reilly fails to mention the forged Selective Service registration? This isn't the first time Bill has lied to protect Obama's crimes including his Connecticut social security number as shown here, here, here, and here.

Among the records missing for Barack Obama that would be available for an ordinary president are passport records, school records such as those from Punahou, Occidental, Columbia and Harvard, Harvard Law Review writings, scholarly articles for the University of Chicago, state bar association records from Illinois, Illinois state senate records, the marriage and divorce documents for his mother, his adoption records and others.

Now it has been revealed that the Cold Case Posse assembled by Sheriff Joe Arpaio in Maricopa County, Ariz., cannot confirm yet that Obama was not born in Kenya and brought to the United States as a days-old infant for his birth to be registered in Hawaii.

The reason? Missing records.

Speculation has held that Obama actually was born in Kenya, and as the son of an American woman and Kenyan father, probably would not have been considered under any circumstances to be a “natural born citizen” of America, as the Constitution demands for presidents.

It’s been revealed that the Kenyan government actually investigated that possibility earlier, without conclusive results.

Now Arpaio’s team, which was assembled to work on a volunteer basis after hundreds of constituents expressed fear that Obama was having his name put on the 2012 election ballot in Arizona using a fraudulent document, has reported that it checked to determine whether a young mother arrived in the United States from Kenya in the days after Obama’s reported Aug. 4, 1961, birth date.

The investigation report said that the records of the Immigration and Naturalization Service cards, which were filled out by passengers of that era arriving on international flights originating outside of the United States, cannot be found.

The investigation sought the records from part of the month of August 1961, and took a researcher to the National Archives in Washington, D.C., where other records of that time and from that time frame are stored.

It is the records from the week of Obama’s birth that cannot be tracked, investigators confirm.

The Arpaio report said the hunt for airline passenger flight manifests for 1961 for foreign flights landing in Honolulu was an attempt to see if Obama’s mother returned at that time.

“The idea was that if Barack Obama had been born in Kenya, or any other location outside the United States, there should be a passenger record of the airline flight on which she, a new mother, returned to Hawaii with her newly born infant son,” the report said.

But “to date, investigators have not been able to locate the relevant airline passenger flight manifests for 1961.”

What was found were records of cards the U.S. Immigration and Naturalization Service required all passengers – including both U.S. citizens and foreign citizens – to fill out and file with passport control when arriving in Honolulu from a foreign city of origin.

The report said, “Microfilm records of INS cards for passengers arriving in New York on foreign files in 1961 have been found in the National Archives only recently; consequently these records have not yet been examined. Microfilm records of INS cards for passengers arriving in Honolulu on foreign files originating around the Pacific rim in 1961 have been examined at the National Archives in Washington, D.C.”

The microfilms that were found for the time period include “NARA Record Group A3573, Reel 184, INA records from July 28, 1961 through Aug. 7, 1961″ and “NARA Record Group A3573, Reel 185, INA records from Aug. 8, 1961 through Aug. 12, 1961.”

However, “Remarkably, all INS records for the week of Obama’s birth, Aug. 1 – Aug. 7, 1961, were missing from the end of Reel 184 and were not discovered anywhere on Reel 185, or any other microfilm reel in the record group,” the report said.

“The National Archives confirmed in a letter written on National Archives stationary that the INS records for foreign flights arriving in Hawaii during the week of Obama’s birth were missing, not only on the microfilm reels examined, but also in the primary database itself,” the report said.

Georgia held its Presidential Primary election Tuesday. Obama’s name was on the ballot. But they haven’t won this battle yet. Today Liberty Legal Foundation filed an appeal with the Georgia Supreme Court challenging the absurd ruling that dismissed our case from the Georgia Superior Court. (In Georgia the Superior Court is a mid-level court. The Supreme Court is the highest Court in Georgia.)

We also filed an emergency motion for preliminary injunction with the Georgia Supreme Court. Since it’s too late to have Obama’s name removed from the primary ballots, we’re asking the Supreme Court to prohibit the Secretary of State from certifying the results of the Democratic Presidential Primary election. Typically it takes about a week for the Secretary of State to certify an election. The results of an election are not official until he certifies. So, if the Supreme Court grants our motion the results of Obama’s Georgia primary election will be on hold pending the outcome of our lawsuit.

This may be our final test for an uncorrupted portion of the justice system in Georgia. As you can see by reading our filings on our website, the Georgia Supreme Court has no excuse for denying our motion. We are not asking for anything that would harm Obama in the short term in any way. We’re not asking for anything that would cost the Georgia taxpayers a dime. All we’re asking for is to have the Secretary of State wait to certify the Democratic Primary election until the Georgia Supreme Court can hear our case. If we lose our case, Obama will still get the Georgia delegates at the Democratic National Convention. But we will have been successful in getting the Court to hear the substance of our case. If we win, we will have upheld Georgia state law and the U.S. Constitution.

My point is this: because the relief we’re asking for in our motion will hurt no one, there is no reason for the Georgia Supreme Court to deny it. It SHOULD be a "no brainer." It hurts no one to grant our motion and it hurts everyone to deny it. So, now we wait to see if the Georgia judicial corruption goes all the way to the top. The video, which Kaczynski says was “licensed from a Boston television station,” shows a young Barack Obama leading a protest at Harvard Law School on behalf of Prof. Derrick Bell, a radical academic tied to Jeremiah Wright--about whom we will be releasing significant information in the coming hours.

However, the video has been selectively edited--either by the Boston television station or by Buzzfeed itself. Over the course of the day, Breitbart.com will be releasing additional footage that has been hidden by Obama's allies in the mainstream media and academia.

Many, many contacts over several months by many people to Rick Santorum’s campaign offices by telephone, letters, and email … and even to his home address in VA via registered postal mail with questions about how, where, and when his father Aldo Santorum [who was born in Italy to non-U.S. Citizen parents] became a US. Citizen, have gone unanswered. Rick it is a simple question and the public has the right to know. When did your immigrant father who came to the USA naturalize? Provide a copy of the paperwork of same to the American electorate. Rick Santorum has been asked repeatedly to provide copies to the public of his father’s Citizenship papers.

The questions to Rick Santorum have gone repeatedly ignored and unanswered. Why? This evasive behavior on this subject by Rick Santorum reminds me of the same type of behavior by Marco Rubio. See the prior story about Marco Rubio and ultimately what we learned as to why he was evading answering the citizenship status of his parents and when they became U.S. Citizens in relation to Marco’s birth date here.

Thus given Rick Santorum’s similar evasive behavior over a lengthy period of time in his not answering the questions and providing copies of the citizenship papers for his father Aldo Santorum, if they exist, to show when Aldo Santorum naturalized as a U.S. Citizen, have begun to dig in earnest to find the answers. We constitutionalists who firmly believe that the “natural born Citizen” clause in the U.S. Constitution is very important and applies to all, and that all candidates for the office of President and Vice President need to publicly prove that status, i.e., that they were born in the USA to two (born or naturalized) U.S. Citizen parents, in light of what we have discovered about the person now residing in the Oval Office, have begun the paper trail research in the various archives to get the facts that Rick Santorum refuses to provide willingly. Why Rick Santorum is making things so difficult for we in the American electorate and is not being transparent and open and giving the public the information they ask for on this matter is beyond me. Come on Rick, provide the information and supporting paperwork voluntarily. However, in the meantime, I hereby share an initial report of what we found or should I say what we did not find in the NARA naturalization records for PA, which is where his father lived up until Rick was born, to our knowledge:

Here is a copy of an emailed report of what I received in Feb 2012 from the regional office of the national archives (NARA) in Philadelphia PA.

Rick Santorum says he is the “true conservative” and that he strongly supports the U.S. Constitution. Well, if that is true, he cannot just ignore Article II Section 1, the presidential eligibility clause, i.e., the “natural born Citizen” requirement to be the President and Commander in Chief. I strongly urge Rick Santorum to voluntarily release the records concerning how, where, and when his father Aldo Santorum became a U.S. Citizen, if he did. The same data for his grandfather Pietro Santorum, who was also an immigrant from Italy and was born in Italy to non-U.S. Citizen parents, would also be helpful and I encourage Rick to release those citizenship papers if they exist too.

Does the proven lack of “natural born Citizen” of the United States status by several nationally promoted Republican candidates for President and/or Vice President explain why the Republican National Committee and Party and their conservative allies in the media have not said a word about Obama’s clear cut lack of “natural born Citizen” status and the criminal acts to cover that up by Obama? Are these Republican and so called conservative allies in the media allowing Obama to destroy the Constitution and Republic all for personal political gain of their party? If so, what does that say about their being “true conservatives” as some so publicly claim?

Sheriff Joe isn't the only American still obsessed with Obama's birth.

According to new polling from PPP, 37 percent of Ohio Republicans, 45 percent of Tennessee Republicans, and 38 percent of Georgia Republicans do not think Obama was born in the United States.

In Tennessee, the number of Republicans who believe that Obama was not born in the United States outweighs those who believe he was not born here 45 percent to 33 percent.

Yes, this is still happening.

Ohio, Georgia, and Tennessee are the three biggest states on Super Tuesday, and they are decisive states in the general election. Ohio gets 18 votes in the electoral college, Georgia gets 16, and Tennessee gets 11.

The fact that more than a third of Republicans in each of these states are birthers is bad news for Obama. People who don't think the president is from this country are pretty unlikely to vote for him in November.

A former Justice Department attorney who blew the whistle on his department's policies is now questioning the promotion of a former defense attorney for an American terrorist to the No. 3 spot at the Justice Department -- specifically charged with crafting U.S. policy on Guantanamo detainees.

J. Christian Adams, once an elections lawyer who accused the Justice Department of racial bias in its decision to not prosecute a voter intimidation case involving the New Black Panther Party, said Tony West's promotion from assistant attorney general for the Civil Division to acting associate attorney general is one more step toward letting radicals run the Justice Department.

"The most dangerous thing is that West is overseeing Gitmo policy. It's not that he's just some guy at the Justice Department licking envelopes," Adams told Fox News on Sunday.

Judicial Watch, a government watchdog group, noted that in Holder's announcement of West's promotion, he "conveniently omitted" West's role as the defense attorney for convicted Al Qaeda terrorist John Walker Lindh, who is serving a 20-year prison sentence after being captured in Afghanistan in 2001 while fighting with the Taliban.

"He actually pleaded guilty to aiding the Taliban and carrying explosives while fighting U.S. troops in the region," Judicial Watch noted of Lindh.

Adams said not only did West represent Lindh, but his firm was also involved in two other defense cases for terrorists working against the U.S.

"Tony West took on, and his firm, took some of the most radical causes for America's enemies before coming to the Justice Department," he said.

"When he took on the representation of John Walker Lindh, even after the sentencing, he was out shilling for him. He said things like ... 'I think he'll have a lot to offer after he gets out of jail.' I mean, what is he going to have to offer after when he gets out of jail? How to endear yourself to prominent Democrat lawyers? I mean there's no reason to be talking like that."

West has previously defended his work for Lindh, saying, "I fully believe that in working on that case, I was recommitting myself to those principles of due process, fairness -- things that separate us from most nations in this world."

West was promoted a week ago. In the announcement, Attorney General Eric Holder said West and Stuart Delery, who was tapped to fill the spot West is leaving, "bring a wealth of experience to their new positions."

"I'm confident they will provide invaluable leadership and will play a critical role in furthering the department's key priorities and fulfilling its traditional missions," he said.

West, who was a a finance co-chairman in President Obama's 2008 election, was nominated for his Civil Division post in January 2009 and approved by the Senate in April of that year. Prior to joining the administration, he was a special assistant attorney general in California and a lawyer at a San Francisco firm.

In The Audacity of Hope, Barack Obama claims that he worried after 9/11 that his name, so similar to that of Osama bin Laden, might harm his political career.

But Obama was not always so worried about misspellings and radical resemblances. He may even have cultivated them as he cast himself as Chicago’s radical champion.

In 1998, a small Chicago theater company staged a play titled The Love Song of Saul Alinsky, dedicated to the life and politics of the radical community organizer whose methods Obama had practiced and taught on Chicago’s South Side.

Obama was not only in the audience, but also took the stage after one performance, participating in a panel discussion that was advertised in the poster for the play.

Recently, veteran Chicago journalist Michael Miner mocked emerging conservative curiosity about the play, along with enduring suspicions about the links between Alinsky and Obama. Writing in the Chicago Reader, Miner described the poster:

Let's take a look at this poster.

It's red—and that right there, like the darkening water that swirls down Janet Leigh's drain [in Psycho’s famous shower scene], is plenty suggestive. It touts a play called The Love Song of Saul Alinsky, Alinsky being the notorious community organizer from Chicago who wrote books with titles like Reveille for Radicals and Rules for Radicals. On it, fists are raised—meaning insurrection is in the air.

And down at the very bottom, crawling across the poster in small print, it mentions the panel discussions that will follow the Sunday performances. The panelists are that era's usual "progressive" suspects: Leon Despres, Monsignor Jack Egan, Studs Terkel . . .

And state senator Barack Obama.

Without reaching the merits of the challenge, Pennsylvania Judge Keith B. Quigley dismissed the ballot challenge lodged against Barack Hussein Obama II by Charles Kerchner and fellow Pennsylvanian Dale Laudenslager.

The Candidate’s Affidavit in PA is routinely signed under oath stating the candidate is eligible for the office they seek. Candidate Barack Obama did not sign under oath the Candidate’s Affidavit which states that he was eligible for the office he is seeking. He did not even sign it at all. The top half was filled out by a lawyer on his behalf and the bottom part with the signatures was left blank. See copy of Obama affidavit here. It was subsequently learned that a Pennsylvania statute provides an exception for presidential candidates that they do not have to complete the Candidate Affidavit, and Obama availed himself of that exception. Hmmh, I wonder why. Other presidential candidates such as Mitt Romney, Ron Paul, and Rick Santorum signed the sworn affidavit stating they were eligible for the office they seek. But since Obama did not sign his, and under PA law he did not have to, it gave Obama an escape hatch in that Obama was not claiming to PA that he was eligible for the office he seeks and thus the court said it did not have any jurisdiction over his eligibility and dismissed the case. The court refused to hear any arguments from the objectors’ attorney, Karen L. Kiefer, that Obama has not proven to any controlling legal authority his exact citizenship status or true legal identity. The court ruled that it is not their jurisdiction to determine candidate eligibility and legal identity for presidents and dismissed the case. So once again we see that no one in the entire USA is willing to assume the responsibility for vetting presidential candidates and thus a fraud like Obama gets away with his criminal identity fraud and as a result of the PA challenge being dismissed, he will thus get another crack in PA to continue his usurpation of the Oval Office and ignoring of the U.S. Constitution, Article II Section 1. After trying to make sense of this tragedy we had to turn our attention to the business at hand - delivering the live stream of the Maricopa County Cold Case Posse's release of their seven-month long investigation into the background of Barack Obama; an investigation no official authority has conducted since first announcing his candidacy prior to 2008.

Knowing one of our primary goals is to elevate this constitutional crisis out of the netroots into the mainstream, we dedicated your/our limited resources to live streaming this event. We want you to know our ability to stream such events is only made possible by you, the Article II Super PAC donors. We, together, made this happen and the public owes you a debt of gratitude for making it happen.

The Article II Super PAC Team also knew we couldn't go it alone so we reached out to the one alternative news source who had been covering this investigation since it was first launched - World Net Daily. SHOCK AND ODD –Along with previous evidence proving the image of Obama’s alleged 1961 “Certificate of Live Birth” posted on the internet in April, 2011 was digitally fabricated, we reveal powerful new evidence which shows that data contained on the document contradicts Obama’s birth narrative and vital statistical accounting methods used at the alleged time of his birth. Vast disparities between the natal information appearing in the image and the standard methods used by federal and municipal governments to code, identify and report the contents of U.S. vital records prove that Obama’s alleged Hawaiian birth record was assembled to intentionally obscure the truth about his natal biography.

NEW YORK, NY – An intensive examination of the contents of Obama’s alleged 1961 “Certificate of Live Birth” image by the most respected experts in vital records accounting and identity investigation reveals that much of the contrived information about his alleged Hawaiian birth simply renders his Natural-born status impossible.

In cooperation with former members of the Social Security Administration’s Records and Claims Investigation office, along with information provided by the National Center for Health Statistics (NCHS), this installment of our report reveals evidence, for the first time, which shows the content of Obama’s document image was hastily and recently manufactured by criminal counterfeiters secretly working in collaboration with both the White House and the municipal government of the State of Hawaii.

Most importantly, the actual data found in the document image reveals that Obama’s natal history is in direct, and even absurd, conflict with historical precedents defining citizenry, demographics and birth metrics as well as protocols governing vital statistics accounting while exposing epic deceptions on a scale never before seen in American political history.

Aside from the contextual contradictions revealed by Obama's alleged 1961 birth records, it can never be dismissed that, according to centuries of legal and doctrinal precedence, the fact that Obama's father was never a U.S. citizen at the time of his birth forever disqualifies him from ever being eligible to hold the office of president unless the Constitution were to have been legally changed prior to his presidency.

The best way to define a natural-born citizen is not so much by what it is, but what it isn't. A natural-born citizen is one born of geographic and biological circumstances, and to have remained under those citizenship metrics from birth to election, which make it impossible for any authority or public perception to consider him or her allied with any status other than naturally-born as a citizen of that nation.

Being born in a geographic location which is under the protection of the U.S. Constitution to two citizen parents are two of the three major components of natural-born citizenship according to historical authority defining the term. The third requirement of natural-born citizenship is continuity of that status without renouncement, voluntary or not, by expatriation, extradition or adoption to foreign parents.

These metrics were not made to hurt the feelings of those not qualified. They were intended to protect the sovereignty of the United States of America and its Constitutional rights through ensuring, to the highest possible degree, the allegiances of its executive powers. For, only the executive branch is led by one.

Failure to understand this is tantamount to willful ignorance and inferior understanding of the reason why American remains the greatest santuary of freedom and protection in world history.

INTRODUCTION

The evolution of methods used to collect, prepare and report vital statistics must be carefully examined in order to understand how Obama exploited Hawaiian culture and its municipality to become America’s first ineligible president.

Vital statistics reporting methods fall under the jurisdiction of the U.S. Department of Health, Center for Disease Control, Census Bureau and multiple branch agencies in public health monitoring. This federal cacophony of bureaucracy works in collaboration with the state health municipalities in each state and U.S. territories to manage the nations vital records and statistics standards.

Vital records are implemented without concern for defining the citizenship status of the subjects on the vital records. Regulations governing the collection and reporting of vital statistics are purposed for improving accuracy, timeliness and availability of vital statistics data to be used for public health services, disease prevention and population.

Most certainly, vital records and statistics were never intended to be used as evidence for determining the eligibility of individuals to hold public office. The information contained in them does not provide an accurate portrayal of the specific natal circumstances, biographical events and geographic indicators required for determining Natural-born citizenry. Vital records simply are not qualified for making such determinations, but in the absence of other vetting resources and effort by authorities, they serve as a starting point for investigation.

Since some have chosen to elicit validation from the absurdity of internet images of alleged 50-year-old birth records, without so much as questioning their authenticity or origins, to determine a previously obscure politician’s eligibility to hold the most powerful and dangerous position in the world, they get what they deserve in their failure to demand a higher vetting standard.

Not only has the American public descended to new depths of endemic irrationality over Obama’s alleged birth records, the complex world of vital records and statistics has been breached to reveal some of the most bizarre protocols and complex logistics of any municipal service.

Tragically, so many remain willing to accept an ambiguous, uncorroborated image of an alleged document posted to the most corruptible and unreliable source of mythology in history, the internet, as the holy grail of some politician’s legitimacy to hold the greatest executive and military power on earth.

OBAMA’S STATISTICAL CONTRADICTIONS

According to the 1961 Vital Statistics of the U.S. Report, Vol.1: Natality (VSUS Report), Hawaii’s 1961 birth statistics were tabulated by the National Vital Statistics office from microfilm copies of the certificates provided by the State of Hawaii’s main Vital Records office in Honolulu.

The records were organized by the main Hawaiian Vital Records office in order of “regional” sequence according to the alphabetical order of the five counties and two metropolitan areas in which the birth record was originated, not where the birth occurred. They were then assembled into “blocks” of 20 records and microfilmed.

Upon delivery to the NCHS, the data was transcribed by personnel and then manually “punched” onto cards prior to their insertion into a card-reader where the data was stored on magnetic tape in a 150+ digit string of code numbers for each record, each digit specifying a distinctive piece of data on the certificate accounting for birth metrics, demographics, age, location, parentage, health statistics, etc.

In successive years, according to the U.S. Vital Statistics System guide, beginning in 1962, the NCHS evolved to electronic data allowing each state to place the records on magnetic tape themselves as the preferred media for delivery of birth data. Computer processing and software media began to be used in the early 1980s.

In 1961, the NCHS stored birth statistics in “blocks” of 20 records on magnetic tape based on a 50-percent sample of even-numbered certificates only. This fact raises doubts about the authenticity of Obama’s alleged certificate given its alleged odd number and yet it contains preliminary codes scribed in the margins of the item entry spaces.

Data found in the image of Obama’s alleged 1961 “Certificate of Live Birth” demonstrates the disparity between the documented evidence about his birth facts and the propaganda supporting his claim to natural-born citizenship as well as America’s first so-called "black" president.

According to the 1961 Vital Statistics Instruction Manual (VSIM) Obama’s alleged 1961 “Certificate of Live Birth” reveals that he is actually not America’s first “black” president. In fact, by vital statistics reporting standards, he is not even bi-racial. This is significant not to the issue of his race, but to the accuracy of the information on the image in comparison to his widely accepted birth narrative, in general.

Demographic coding of the information as it is stated on the image causes him to be classified as “white”, not “black”, contrary to what media propaganda has tried to convince us. Vital statistics reporting protocols state that a child’s race is classified by the race of the parents with consideration given in the following priority.

1. If the race of both parents is coded the same, the child is that race, as well.
2. If one parent is classified as white (Code 1) and the other is classified as one of codes 0 or 2 through 8, then the child’s race is also classified as one of the classification codes found in 0 or 2 through 8.
3. The child’s race is classified by the father’s race unless the father’s race code is 9, which means “Not stated” or “not classifiable”, then the child’s race is classified by the mother’s race.

Race codes for reporting the mother’s and father’s race on the standard Certificate of Live Birth in 1961 were the same codes and were as follows:

Recall, Obama’s father’s race is shown as “African” which does not appear in the “Detail Race of Father” table as a classifiable race according the NCHS. It is coded as a number 9 which is “Not Stated”. Therefore Obama’s race is based on his mother’s, not his father’s, by federal law. We know the vital statistics of Obama’s father’s race was recorded using this code because within the margins of Obama’s alleged 1961 “Certificate of Live Birth” there are preliminary coding marks written in pencil as prescribed by the Vital Statistics Instruction Manual for 1961 reporting. Obama’s certificate has the number “9” scribed in the margin of the item for his father’s race.

PLAINTIFF’S MEMORANDUM IN OPPOSITION TO DEFENDANTS MOTION TO DISMISS COMPLAINT, FILED ON JANUARY 3, 2012

Plaintiff Duncan Sunahara is the natural brother of Virginia Sunahara, deceased. On or about November 22, 2011, Plaintiff requested from the State of Hawaii, Department of Health (hereafter referred to as “State”), an estimate of the cost and expense to obtain a certified copy of Virginia Sunahara’s original Certificate of Live Birth (hereafter “Birth Certificate”), pursuant to Hawaii Revised Statute § 338-13(a). As stated in the Complaint, the Department of Health did not provide an estimate of the costs or provide a copy of Virginia Sunahara’s original Birth Certificate. The Department of Health had previously provided a “computer generated abstract” of Virginia Sunahara’s birth certificate. (See Abstract of Birth Certificate as Exhibit 1). However, a “computer generated abstract” is not a certified copy of an original birth certificate.

Defendant State contends that because it provided a “computer generated abstract of the birth certificate,” the Plaintiff is not entitled to a certified copy of Virginia Sunahara’s original Birth Certificate, and Plaintiff also is not entitled to “have access to that original.” (State’s Memorandum in Support of Motion to Dismiss, at pp. 2-3).

However, HRS § 338-13(a) expressly states, “the department of health shall upon request, furnish to any applicant a certified copy of any certificate, or the contents of any certificate on file in the department. . .” (Emphasis added). (See HRS § 338-13, as Exhibit 2). HAWAII RULES OF EVIDENCE, Rule 202(b) requires “mandatory judicial notice of law.” “The court shall take judicial notice of (1) the common law), (2) the constitution and statutes of the United States and of every state, territory, and other jurisdiction of the United States, . . .” (Emphasis added).

Defendant State is required to produce a copy of Virginia Sunahara’s original Birth Certificate, and not merely a “computer generated abstract” HRS § 92F-11(d) also states, “Each agency shall assure reasonable access to facilities for duplicating records. . .” The Plaintiff has sufficiently stated claims for relief which precludes dismissal or summary judgment.

Defendant State and the Department of Health have not complied with the requirements of HRS § 338-13(a) merely because a “computer generated abstract” was provided to the Plaintiff. (See Abstract as Exhibit 1). Defendant State claims that, “The Director (Department of Health) has the authority to select and adopt the process of providing computer generated abstracts of vital records. . .” (Memorandum in Support, at pp. 4-5). The State relies on HRS § 338-13(c), which states, “Copies may be made by photography, dry copy reproduction, typing, computer printout or other process approved by the director of health.” (Emphasis added).

However, the State misinterprets this statutory provision because it merely provides the Director with discretion to choose the “method or process” of producing copies, either by “photography, dry copy, typing or computer printout.” Contrary to the State’s “interpretation,” HRS § 338-13(c) does not grant the Director any “discretion” or authority to disregard the requirements of HRS § 338-13(a) to provide a “certified copy of any certificate.” This section only grants the Director the discretion and authority to approve the “manner or process” of making copies. If the Legislature had intended to grant the Director the sole discretion of providing only a “computer generated abstract,” the Legislature would have eliminated the requirement of providing “a certified copy of any certificate,” or alternatively, the Legislature could have expressly granted the Director with similar discretion or authority as in HRS § 338-13(a), but the Legislature has not done so.

In addition, HRS § 338-13(c) cannot be construed as granting the Department of Health the sole discretion to provide a “computer generated abstract,” in lieu of a copy of a certified original Birth Certificate. This would effectively nullify the requirement of HRS § 338-13(a) of providing a “certified copy of any certificate.” HOH Corp. v. Motor Vehicle Industry Licensing Bd, DCCA, 69 Haw. 135, 736 P.2d 1271 (1987) (The law has long been clear that agencies may not nullify statutes).

It is also a general rule of construction in the interpretation of a statute, “courts may not take, strike, or read anything out of a statute, or delete, subtract, or omit anything.” 73 Am Jur 2d STATUTES § 200. “[I]t is a cardinal rule of statutory construction that significance and effect should, if possible, . . . be accorded to every part of the act, including every section, paragraph, sentence or clause, phrase, and word, phrase, sentence and word.” (Emphasis added). 73 Am Jur 2d STATUTES § 250.

“When construing a statute, our foremost obligation is to ascertain and give effect to the intention of the legislature which is to be obtained primarily from the language contained in the statute itself. Moreover, it is well-settled that courts are bound to give effect to all parts of a statute, and that no clause, sentence or word shall be construed as superfluous, void, or insignificant if a construction can be legitimately found which will give force to and preserve all words of the statute.” (Emphasis added). State of Hawaii v. Magoon, 75 Haw. 164, 177, 858 P.2d 712 (1993); Hi Kai Inv. v. Aloha Futons, 84 Haw. 75, 929 P.2d 88 (1996) (The court, whenever possible, interprets every word, clause and sentence of a statute to give them effect). The Court must give effect to both HRS § 338-13(a) which requires the Department of Health to provide a “certified copy of any certificate,” and HRS § 338-13(c) which provides the Director only discretion as to the method of copying records.

3. The Department of Health Does Not Have Any Discretion to Provide a “Computer Generated Abstract,” In Lieu of a Certified Copy of an Original Certificate

Although HRS § 338-13(a) states the Department of Health is to, “furnish to any applicant a certified copy of any certificate, or the contents of any certificate, or any part thereof,” this does not grant the Department an option or discretion to provide a “computer generated abstract” instead of a certified copy of Virginia Sunahara’s original Birth Certificate. While the term “or” is normally used a disjunctive, with a choice among two or more things, Hawaii law, HRS § 1-18, expressly states, “Each of the terms ‘or’ and ‘and,’ has the meaning of the other or both.” (Emphasis added). Therefore, under HRS § 1-18, the term “or” as used in HRS § 338-13(a), is to be interpreted as “and.”

CONCLUSION

Defendant State has filed this motion to dismiss pursuant to HRCP, Rule 12(b)(6), claiming that Plaintiff Duncan Sunahara has failed to state a claim for which relief can be granted. However, as discussed herein, Defendant State has misinterpreted the plain and unambiguous language of the statute, HRS § 338-13. The Court should find that HRS § 338-13(a) requires the Department of Health to provide Plaintiff a certified copy of the original Birth Certificate of his deceased sister, Virginia Sunahara. The Court should also find that the Department cannot meet its statutory requirement by merely providing a “computer generated abstract.” In addition, even if the “contents” of such an abstract can be “considered for all purposes, the same as the original,” is not dispositive and does not relieve the Department of its statutory duty to provide a “certified copy of any certificate.”

NEW YORK, NY - While preparing the second part of our investigative report on the statistical examination of the contents of the image of Obama's alleged 1961 "Certificate of Live Birth", there are a few things we need to be reminded of about this contemptible, overemphasized record.

Lt. Colonel, Dr. Terry Lakin, willingly sacrificed his unblemished 20-year military career and served prison time by rightfully refusing deployment orders when Obama refused to provide it.

Dr. Jerome Corsi, author of multiple investigative best sellers and nemesis to John Kerry’s mendacious attempt at the 2004 U.S. presidency, published yet another best seller because Obama refused to provide it.

A State of Georgia administrative law court convened a hearing over it.

Arizona law enforcement and investigative personnel are preparing to issue a formal report over it.

Before all this, Hillary Clinton “PUMA” supporters started the "birther" movement during the 2008 Primary campaign when Obama refused to provide it.

Former Philadelphia Deputy District Attorney and life-long registered Democrat, Philip Berg filed a lawsuit in August of 2008 because Obama refused to provide it.

“…Natural-born citizens, are those born in the country, of parents who are citizens. As the society cannot exist and perpetuate itself otherwise than by the children of the citizens, those children naturally follow the condition of their fathers, and succeed to all their rights…The country of the fathers is therefore that of the children…in order to be of the country, it is necessary that a person be born of a father who is a citizen...”

Senate Resolution 511 affirming John McCain’s presidential eligibility was debated and unanimously passed based on a definition of natural-born parentage which his opponent did not possess, after Congressional senators refused to demand it.

Congressional representatives tried eight times to change the Constitution by removing the Natural-born citizenship clause of Article II between 2004 and 2008 when they couldn’t find it.

Former senior Hawaii elections clerk, Tim Adams, in charge of verifying voter eligibility, with access to national and international identity verification databases, as well as hospital records, was told to stop asking about it because it, apparently, didn’t exist.

Seven different reporters from four newspapers in Hawaii, and a national radio host, could not find it, yet that same media repelled inquiries for years claiming that Hawaii’s health department could not provide it.

Former director of the Hawaiian Department of Health, Dr. Chiyome Fukino, said she had seen it, but her boss, Hawaii governor and self proclaimed “friend” of Obama, Neil Abercrombie, as manager of that same municipality, could not find it.

Obama says that he possessed it as a teenager in the 1970s, but current Lt. governor of Hawaii, Brian Schatz, serving as the Democrat Party of Hawaii Chairman in 2008, across the street from the Hawaiian Department of Health, refused to certify Obama’s nomination as “constitutionally eligible” when he could not find it.

The Hawaiian district attorney was forced to refer a customized copy of an Official Certification of Nomination to the DNC party headquarters, headed by Nancy Pelosi, for permission to “legally” put Obama’s name on the ballot in his own state, because he couldn’t find it.

Former Hawaii election’s commission chairman, Kevin Cronin, resigned after a dispute with Schatz over eligibility documentation procedures and deadlines related to Obama’s appearance on the Hawaiian ballot in October, 2008, when he couldn’t find it.

34-year-old Schatz was suddenly elevated to his current status as the youngest Lt. Governor in Hawaii’s history without ever having served in government. Schatz’s won the election without public appearance or publicly campaigning, having filed an application for his candidacy just days before the ballot inclusion deadline, against the protests of nearly ten other long-standing democrats who suspected Schatz’ sudden ascendance to power was because he remained silent about not being able to find it.

The Hawaii Election Commission called a special session with Schatz and the attorney general along with Obama, who made an emergency trip to Hawaii to visit his sick grandmother, on October 24th, 2008, the deadline for being included on the Hawaii ballot, to discuss Obama’s eligibility, when they couldn’t find it.

Donald Trump conducted an investigation as a prospective presidential candidate, (until his television contract was renewed), but he couldn’t find it.

Then suddenly, in April, 2011, right before the release of Corsi’s book, and Lakin from prison, and Trump’s television deal, and Fukino from her position, and the 2012 presidential campaigns, an image of it suddenly appears.

Pristine and jewel-laden for the world to behold, the most conveniently absent document in American history is suffered forthwith on the most corruptible, anonymously accessible “crime scene” in human history, the internet.

When the absurdity of the image began to pressure the Obama administration to answer for its belated appearance, bizarre format and lack of authenticity, rather than uphold the “transparency touchstone” of his fraudulent presidency, he allegedly orders the end of Osama Bin Laden in a Pakistani raid and secretly disposes of the body without public confirmation or evidence while telling the world what a wonderful president he thinks he is.

Meanwhile, we learn the Pakistani government conveniently acquired top secret military technology from “wreckage” we left after the raid as compensation for that government’s cooperation in upholding Obama’s mendacious tale that Bin Laden was, in fact, alive before he released his birth certificate, and then conveniently dead after.

When the founding fathers composed the Constitution, they had no idea what a birth certificate was. They were guided by the timelessness of natural law, the laws of nature, to determine the matter of course. By these laws, America became the greatest nation in human history.

The only so-called vital records in the late 1700s were “Bills of Mortality” which listed the names of dead people and were posted by undertakers at the outer limits of villages ravaged by various epidemics such as plague and typhoid fever. The only method for recording births came from parishioners who informally documented infant christenings in the church.

The language used by the founders to write the U.S. Constitution was based in the culture of the era, just as ours is today in how we speak, write and construct our laws. Therefore, drawing nomenclature from precedence, they were forced to convey concepts of their understanding of advanced citizenry by citing natural law and highly regarded principles which were embraced by the greatest majority of the people.

The appeal from the Secretary of State’s decision finding that President Obama is qualified to appear on the Presidential Preference Primary ballot is one in a long line of persistent challenges filed across the country since 2008. Not a single challenge has ever been upheld.

An effort to harass the President continues with qualification challenges filed across the country and in Georgia. Challengers ignore procedural and evidentiary requirements because their claims are without merit, based on fantasy, and offered in pursuit of a political agenda. See, for example, Rhodes v. MacDonald, 670 F. Supp.2d 1363, 1364 (M.D. Ga. 2009), aff’d, 2010 WL 892848 (11th Cir. March 15, 2010) cert. denied, 129 S. Ct. 2830 (2009)(“When a lawyer uses the courts as a platform for political agenda disconnected from any legitimate legal cause of action, that lawyer abuses her privilege to practice law.”)

President Obama was a United States citizen from the moment of his birth in Hawaii. Since he held citizenship from birth, all Constitutional qualifications have been met. Ankeny v. Governor of State of Indiana, 916 N.E.2d 678 (Ind. App., 2009); see, United States v. Marguet-Pillado, 648 F.3d 1001, 1006 (9th Cir., 2011). There is no basis to question the President’s citizenship or qualifications to hold office. Specially appearing before this Court, respondent show that petitioner’s actions should be dismissed as they have been in numerous cases for lack of jurisdiction over the subject matter, failure of service of process, and failure to state a claim upon which relief can be granted.

An Open Letter to Orly Taitz, re: Defamatory Statements

Ms. Taitz:

As we previously stated, you have made multiple defamatory statements about Larry Klayman and some supporters, including us, causing severe harm. We supported you for years, because you were about the only game in town, after Apuzzo and Donofrio concluded that the federal courts would not hear any argument, no matter how logical, how grounded in fact and law.

Now, there are many ballot challenges granted instant “standing” and new attorneys are joining the fight. Obama State Ballot Challenge has helped to focus attention on the challenges and facilitate activity. We do not appreciate your non-productive infighting with other patriots in the movement. In fact, you are actively and maliciously attempting to hurt our efforts, in a manner nearly indistinguishable from that of the “Obama” forces. We know that they are enjoying sitting back and watching you do their work for them.

We had stayed quiet and counseled others not to get involved in the fray with you. George tried speaking to you twice earlier and again on 2/23/12, but, you would not even allow him to complete a sentence without interrupting. But, you have crossed into libelous action, so it has come to this and now we must reluctantly speak out. It’s bad enough that you routinely attack movement patriots, but now you are damaging the efforts of one of the finest attorneys in the nation. And that is unacceptable. Unlike others you have bulldozed, we will not be so passive, especially since you have ignored letters from our attorney.

You have little or no idea what you are even talking about, flinging around allegations, slyly implying misconduct and did not make a competent, good faith effort to ascertain the truth. In any case, it is none of your business how we conduct our campaigns, since we are complying with all laws and answer any legitimate questions to donors and patriot allies. We are writing this only to document your offenses and inform the public of what is really going on.

It is obvious that you feel threatened, are jealous of any other activity in the eligibility movement, are fearful of any “competition” and believe that a dollar contributed anywhere else but to you is a dollar stolen from you.

We specifically reference some of your inflammatory, defamatory, misleading and fallacious blog postings. It is quite clear that you have an “agenda” to discredit Mr. Klayman and us. Our response to the postings is below and we have also marked up some of them in Appendix A:

- It seems as though we committed the unforgivable sin of helping to raise money for the Hatfield/Swensson Atlanta challenge and publicity/education activities. After that, you, who we were on excellent terms with, became an even worse enemy than “Obama.” More recently, we started fundraising for Larry Klayman’s planned work. The attacks only increased.

- All of your absurd “concerns” and inaccurate statements could have been avoided, simply by calling and asking before recklessly writing in your blog. Your failure to exercise due diligence prior to posting falsehoods, incomplete and one- sided information, has resulted in creating a highly misleading impression that we are dishonest, possibly taking money and failing to use it as advertised—all untrue. You also dredged up and presented only negative statements about Larry Klayman, including various defamatory statements which hold him in a false light. For instance, Klayman’s PA law license expired. He has not done any work there in two decades. He was not subjected to any disciplinary actions there. He has not been convicted of any crime and can enter cases in California pro hac vice, as you know.

- Article II PAC is not involved in collecting money for legal defense. Pamela Barnett and George Miller are no longer with Article II SuperPAC or Article II Legal Defense Fund, but we maintain a strategic alliance, since we have closely aligned goals, but different approaches and activities.

- Pamela Barnett, George Miller and Sam Sewell have never taken a penny from Article II PAC, Article II Legal Fund, or any other similar fundraising efforts. We have only paid in. I’m not aware that others you have named have taken any money either, except for a few who had legitimate expense reimbursements for travel, living and assigned activities, you know, like you take. I am informed by the Treasurer that none of that came out of the legal fund.

- ObamaBallotChallenge.com has not collected any money at all, although we have heavily promoted multiple such campaigns for others, such as Kerchner, Swensson/Hatfield, Klayman, Arpaio, you, etc.

- Klayman has never been associated with the Article II SuperPAC, but we were/are still using the Article II Legal Defense Fund to raise money for his ballot challenge efforts.

- Article II Legal Defense Fund will be sending funds to Klayman.

- RE: Taitz statement: The question is: who is lying? Was Klayman paid or not? If he was paid, than he needs to refund the donors, as he did not file law suits as he was supposed to.

No one is lying except you- or at least badly misleading unsuspecting readers of your blog. Klayman received only partial payment of his $25K retainer, but only after he had already started work on his own initiative, without the promised retainer. He should be praised, not vilified.

- We have raised funds from other sources. We have not yet received any funds from Article II Legal Defense fund.

- The 96 hour deadline you spoke of was in our initial ads, which was in fact required to enable us to engage Klayman in sufficient time to file an initial complaint. We didn’t raise the full amount in time, but were successful in getting him to graciously start some work anyway, the same day that a citizen filed a complaint, who has subsequently worked with Larry to begin modifying it to incorporate improvements. Klayman is planning strategy, researching statutes and looking for appropriate jurisdictions to file additional complaints in.

- For you to make a leap of logic that we are somehow defrauding donors, because Klayman wasn’t able to research, write and file a complaint in the four or so hours he worked before a citizen complaint was filed on 2/16 without his input– is beyond ridiculous, but quite typical of your communications style and “logic.”

- That Klayman does not have a CA license is largely irrelevant and seems designed to imply that he cannot mount any efforts here in CA. As you know, he can enter cases in California pro hac vice, and lawyers that practice nationally do so on a routine basis. No one can be licensed in all 50 states and that is why all courts allow attorneys to enter cases pro hac vice.

- Larry, the founder of Judicial Watch, has stated publicly that he left it to run for a Florida U.S. Senate seat. At least he had the good sense to focus on one thing. Running for the Senate, if seriously, is a full-time job.

- We have already explained Klayman’s response to the child support issue, grounded in law and fact, unlike your one sided presentation, which inaccurately portrayed him as a deadbeat Dad. You did not give Klayman or us any chance to respond to your misleading assertions about him and others before that on other matters, repeatedly since January. You routinely censor our postings on your site, so we have ceased trying.

- Klayman has never been convicted of anything. He has not had a license suspended or revoked. He is following the law.

- It is interesting that “Constance Ruffley” of Judicial Watch went out of her way to attend your presentation, switching topics to comment on Klayman’s involvement in the “birther” suits and his personal life (which is none of her or your business), since Judicial Watch completely blew us off when we approached them about helping. You seem to place a lot of weight on words of an office clerk with an agenda.

- The fact that multiple Article II Legal Fund ads run on ObamaBallotChallenge.com and an Obama Ballot Challenge ad runs on Art2 SuperPAC does not mean that we are each members of the other. We left to focus on the Ballot Challenges, while Article II SuperPAC will focus mainly on education and publicity on….. Article II issues. So, there is obviously potential synergy, but different missions.

- Your seemingly obsessive interest in Klayman is fascinating. It seems that you are focused on attacking Klayman and impeding his mission, when you should instead be focused on building the movement and cooperating.

- What results have you achieved in four years of taking OPM (Other peoples’ money)? All these misstatements, if not lies, or deliberate shading of the truth, are at the very least the result of your fact-finding incompetence, or a deliberate attempt to mislead your readers, not a good attribute in an attorney.

- We can’t tell people who to support, but will only say that there are now multiple attorneys working on cases, mostly ballot challenges. We advise our readers to check their track records, qualifications and achievements before making their choices. It is not Larry’s fault that we only started working with him recently and haven’t raised the agreed upon money yet. This is more attributable to a late start and justifiable disappointment of people in the legal process, especially after the initial Georgia defeat and others before that.

- Now, we must deal with an attorney (you) seemingly intent upon sabotaging the efforts of a genuine American patriot and outstanding achiever, instead of warmly welcoming him and cooperating. The Larry Klayman projects are in progress. Same is true of the Kerchner, Hatfield/Swenson and Irion efforts. And yours. The more the merrier. You know we also promoted you vigorously, but find that far more difficult now, when you keep attacking us and others.

- You need to quickly make amends by not only deleting all inaccurate and misleading material, but by posting on your blog and sending full and unqualified retractions out immediately to all of your lists. As our attorney wrote you, you have caused ongoing and severe harm. So it would behoove you and be in your best interests to commence corrective actions immediately, rather than compounding and extending your offenses. Our group has nothing to apologize for, except not raising money fast enough. We are open for business and on the cases!

We have commented on some specific passages in Orly Taitz blog postings, below. We see that you added more garbage today (2/26). We will not even address the latest one, except to say that you are in no position to be making any demands. We meet all legal requirements and answer questions of donors and allied patriots. Why don’t you try answering the same questions and further explain why you have been taking donors’ money for over 3 years with no accounting?

Article II Super PAC is gearing up for the 2012 general elections where we are currently working to elevate the debate about presidential qualifications from the netroots into the mainstream conversation. To accomplish this we have invested donor contributions into “live streaming” events such as last month’s Georgia Office of State Hearing’s and have recently teamed up with World Net Daily to “live stream” the Maricopa County Cold Case Posse Investigation into Barack H. Obama. We will continue to seek out opportunities to “live stream” events that focus on presidential qualifications and related constitutional issues. After all, it is Article II that drives our mission and work.

Article II Legal Defense Fund is a separate legal entity from Article II Super PAC. We clearly state this at both sites, but for whatever reason Taitz nor her staff bother to read.

The Article II Legal Defense Fund serves as a fundraising platform for those citizens who wish to submit a ballot challenge in their respective states and hire attorney’s who are licensed in said states. Article II Legal Defense Fund serves as a fundraising platform and depository for said funds. Nothing more. Nothing less.

It is important for citizens and donors to understand, not every ballot challenger wishes to engage the services of Taitz. Rather, they wish to seek private counsel licensed to practice law in their respective state or an attorney from out of state who they hold confidence. The Plaintiffs in California, Florida, Georgia, Arizona, Pennsylvania and several more states chose to secure counsel they wished to work with, which is their right.

As for those citizens who have engaged Mr. Klayman’s legal services that is their prerogative and Ms. Taitz should not be casting aspersions or making assumptions about that which she has no knowledge. The plaintiffs in these various ballot challenges have exercised their right to secure counsel for whom they have confidence and respect, and they should not be subjected to the incessant diatribe and insults of a frustrated and angry Ms. Taitz.

Nevertheless, out of an abundance of caution, Article II Legal Defense Fund reached out to the FL/CA Plaintiffs on February 23, 2012 and have received the necessary assurances that Mr. Klayman is very much involved with the Ballot Challenges both in Florida and California. The fact of the matter is that Mr. Klayman is coming on board on an existing case in Florida and Ms. Taitz would be best served by not jumping to conclusions.

As to Taitz’s claim that donors who have contributed to the CA and FL efforts are being defrauded; this is an outright falsehood and irresponsible at best. However, if the donors who have contributed to either one of these efforts wish to receive their donation back we’d gladly comply. It speaks volumes that none have. Obviously they too have full faith in the lead Plaintiffs and Mr. Klayman.

Again, Article II Legal Defense Fund simply serves as a fundraising platform and depository on behalf of citizens. It is the Plaintiffs who hire counsel, manage the private attorney-client relationship, and work out their respective legal strategy.

Perhaps Taitz would be more effective if she would concentrate more on her own efforts and spend less time making libelous statements toward those of us who are lending a hand and taking a lead to assist litigants in various states. Taitz should immediately stop injecting herself into the activities of others, especially Article II Super PAC, Article Legal Defense Fund and the CA/FL Plaintiffs. Taitz’s failure to cease and desist will only continue to hurt our common objective and will in fact necessitate a need for legal action to put and end once and for all to such scurrilous insults and claims.

The misrepresentation of facts by Taitz about who Article II Super PAC and Article II Legal Defense Fund must cease immediately. This invitation has been extended many times since we launched the PAC and LDF, but to date Taitz has chosen not to reach out and learn the facts regarding our work. The comments drew applause from the crowd, which was assembled to hear both Arpaio and presidential candidate Rick Santorum.

A state commission in Indiana that was asked to review whether Barack Obama is eligible to be on the state’s 2012 ballot has scheduled a hearing for Friday, and warned the parties to the argument that those who fail to attend may be subject to a default decision.

The notice was signed by Trent Deckard and J. Bradley King, co-directors of the Indiana Election Commission, and regards case No. 2012-176, which is a challenge to Obama brought by Karl Swihart.

“The hearing is called to determine the merits of the candidate challenge pursuant to Indiana Code 3-8-1-2,” the notice, addressed to Barack Obama at a Chicago address for his campaign, explains. “A party who fails to attend or participate in the hearing may be held in default or have the proceeding dismissed.”

A similar hearing was held last month in Georgia, and Obama and his attorney refused to participate. Instead of accepting the judge’s offer of a default judgment then, which probably would have recommended to the secretary of state that Obama’s name not be on the 2012 election ballot in the state, attorneys for several citizens raising various issues asked to present evidence regarding Obama’s ineligibility.

The judge, Michael Malihi, allowed that in several cases, but then in one sweeping opinion that didn’t even respond to some of the legal motions pending, he dismissed the testimony and ruled without evidence from Obama that he should be on the 2012 state election ballot.

The move is part of an effort on the part of citizens across the country to use each state’s election procedures to challenge Obama’s name on state ballots. It is the states that run elections, not the federal government, and the presidential race results are just a compilation of the elections run by all the states.

There are two mainstream arguments in the dispute: that he either was not born in the state of Hawaii as he has claimed, which could make him ineligible under the Constitution’s requirements that a president be a “natural born citizen,” or that he doesn’t qualify for that status since he’s written that his father never was a U.S. citizen.

Many analysts believe the Founders considered a “natural born citizen” to be the offspring of two citizen parents. A Supreme Court opinion from 1875 seems to support that argument.

California attorney Orly Taitz, who has handled a number of cases challenging Obama’s tenure in the Oval Office on the grounds he’s not eligible, has told WND, “Indiana is a very important state, as recently they threw out of office … their Secretary of State Charlie White for not updating his voter registration card.”

“It is important to shove in front of the elections board … all the evidence of Obama using a stolen Social Security number and a forgery instead of a birth certificate. I want to see how they will justify keeping … Barack Obama on the ballot after they removed the secretary of state for something minor,” she said.

As it now stands, with Republican presidential candidates seen as weak and damaged, it is likely that Barack Hussein Obama will be re-elected in 2012. Not that Romney, Santorum and Gingrich would be the solution to the nation’s ills – indeed, “We the People” must roll up our sleeves and wage a second American revolution as I have written many times – but the Republicans who could win – Jeb Bush, Chris Christie and Mike Huckabee – are not likely to step forward to bail out the Grand Old Party. They have regrettably put political calculations ahead of the country’s interests and are waiting until 2016, when there will be no sitting incumbent president to run against, to likely make their move. But by that time the nation will be nearly destroyed.

America is in dire straits. Our economy, whatever the few “good economic indicators” Hussein Obama has been recently crowing about, continues to sink under a mountain of growing debt. The morals and ethics of our people are at an all-time low, furthered by the low-class “permissiveness” espoused by the leftist media, and our national security hangs in the balance.

As only one example, our most important ally, Israel, is being hung out to dry – forced to go it alone in attacking the Islamic Republic of Iran and eliminating the existential nuclear threat of this radical terrorist state, so bent on the destruction of not only the Jewish people, but Christians as well. The sanctions put in place at the insistence of Hussein Obama and his compromised secretary of state, Hillary Clinton, will not in the end deter the mullahs in Tehran and are only an excuse not to take strong decisive military action. The reality is that the Israelis cannot take out the Iranian nuclear sites alone. They do not have the large long-range planes and enough bunker-busting bombs to do the job by themselves. Once these radical neo-Nazi Islamic terrorists get their hands on atomic bombs, with the means to deliver them intercontinentally, the United States will also be under constant threat of attack. Unlike the North Koreans, the mullahs are happy to risk dying for their faux god, Allah. That is their sick Muslim faith, and that is their destiny. Much like Adolf Hitler, they have told us just exactly what they intend to do. A second Holocaust, this time one that “gets the job done fully,” is their fanatical religious mission.

It comes as no surprise Hussein Obama is ignoring Israeli cries for help. Born to a Muslim Kenyan father who hated America, and himself historically close to black Muslim leaders like Louis Farrakhan of the Nation of Islam, Hussein Obama instinctively and viscerally despises Jews and Christians, no matter how he pretended to believe in Judeo-Christian principles as the “Manchurian Candidate.” Indeed, during the run-up to the 2008 presidential elections, when former Clinton White House communications director and then ABC commentator George Stephanopoulos asked Hussein Obama about his religion, he referred to his Muslim roots. Stephanopoulos then broke in, showing his Democratic allegiances, interrupting Hussein Obama to “remind” him that he really meant “Christian.”

I just returned from Harrisburg PA, our state capital, where today we filed in the Commonwealth Court of PA and with the Secretary of State office the ballot access challenge/objection to Obama being on the ballot in PA since Obama is NOT a “natural born Citizen of the United States” and is thus constitutionally not eligible for the office he seeks. Grounds for this motion, as set forth below are that Mr. Irion fulfills the requirements set forth in Rule 4.4, is qualified to represent the Petitioner, represented the Petitioner in the OSAH proceeding to which this petition requests review, and will facilitate efficient adjudication of the instant matter.

Attorney Irion is licensed to practice law and is a member of in good standing of the bar in the State of Tennessee. Statements of Fact

(I) Barack H. Obama has shown a picture of a purported birth certificate indicating his birth in Honolulu, Hawaii on August 4, 1961 to American citizen mother, Stanley Ann Dunham, and Kenyan British subject father, Barack Obama Senior.

(II) Barack Obama Sr. was born in the British Colony of Kenya on June 18, 1936.

(III) Birth in Kenya made Barack Obama Sr. a British subject, according to and governed by the British Nationality Act of 1948, Part I, Section 1.

(IV) The British National Act of 1948 indicates that Barack H. Obama II was born a British subject, since father, Barack Obama Senior, was a citizen of the British Colony of Kenya. (British Nationality Act of 1948, Part II, Section 5)

(V) Upon receiving the Democrat Party nomination to run for President of the United States in the 2008 General Election, the Democrat Party sent to the Department of State of Florida a nomination certificate stating that Barack H. Obama was “Duly Nominated” to run for President on the Democrat ticket.

(VI) The Republican Party Nomination certificate, sent to the Department of State of Florida, nominating John S. McCain for President, and Sarah Palin for Vice President, states that the candidates meet “the constitutional requirements” of those offices.

(Exhibit B)

(VII) The Secretary of State of Florida has a ministerial duty with regard to placing names of the candidates on election ballots. There is no claim made by the Secretary that any candidate on any ballot is eligible constitutionally for the office they seek, only that they have been “duly qualified.” (Fl. ss 99.061(6), Cherry v. Stone, 265 So. 2d. 56,58 (Fl. 1972)

(VIII) Neither John McCain nor Barack H. Obama signed the “Federal Candidate Oath” of Florida Statute 99.021(2), avowing Constitutional eligibility that was required of “all Federal candidates” prior to the 2008 General Election.

(IX) 2011-Chapter 40 Florida Statutes (HB 1355), enacted in May 2011, has excused
Presidential and Vice Presidential candidates from taking the Federal Candidate Oath, which asserts Constitutional eligibility, by the insertion of Fl. ss. 99.021(3).

(X)Article 2 Section 1, U.S. Constitution, requires that the President be at least 35 years old, 14 years a resident of the United States, and “shall” be a natural born citizen. (Article 2, Section 1, U.S. Constitution).

(XI) The purpose of the requirement that the President be a natural born citizen is rooted in the desire to prevent foreign influence into the top executive offices of the United States government, and in the Commander in chief of the United States armed forces. (Letter from John Jay to George Washington, Federalist #68, Alexander Hamilton, March 1778).

(XII) Barack H. Obama’s campaign, paid for by Obama for America, has claimed that he is a “native citizen” and an ‘American-born citizen.' (www.fightthesmears.com/birth), (www.AttackWatch.com).

(XIII) Secretary of State, Kurt Browning, has taken an oath to “support the U.S. Constitution.” (2011 Fl. ss.876.05)

(XIV) Secretary of State of Florida, Kurt Browning, by statute, must provide “voter education.” (2011 Fl. ss. 97.21(6) )

(XV) Plaintiff, Michael C. Voeltz, as a Florida registered voter, has taken an oath to “protect and defend” the U.S. Constitution and the Constitution of Florida.

Officials with Grassfire Nation, a key coordinating group for tea-party-type activities and issues, say the Department of Justice’s investigation of Maricopa, Ariz., County Sheriff Joe Arpaio is nothing more than a political attack.

And to offer encouragement to the sheriff, Darla Dawald, representing the Grassfire Nation group, has presented Arpaio with a petition of some 100,000 signatures from people who have declared their support for the law-enforcement officer.

Grassfire Nation supports the Patriot Action Network, which calls itself the “nation’s largest conservative social action network, involving tens of thousands of citizens,” including many tea party members.

The petition demands DOJ prove its accusations that Arpaio’s office has engaged in a policy to systematically violate the civil rights of Hispanics, which WND has reported DOJ refuses to do.

The petition claims the DOJ investigation is nothing more than a baseless, politically motivated attack on Arpaio.

“Citizens belonging to this grass roots movement who called themselves ‘Grassroots Nation’ have followed the situation and say they feel the federal government has orchestrated an attack on the Sheriff for Obama’s political gain, who hopes to ingratiate himself to the Hispanic American voting block,” the petition read.

The petition’s “Statement of Support” says:

“As a Citizen of the United States, I am declaring my support for Sheriff Joe Arpaio, the sheriff’s lawful practices in prosecuting criminal and his unflinching stand in handling the illegal immigration crisis in his home state of Arizona. I demand that the U.S. Department of Justice release any evidence involving the allegations against Sheriff Joe and his department’s practices. If proven unfounded, I demand an immediate end to the politically motivated witch-hunt against the sheriff and his department, and a public apology from Attorney General Holder.”

At the time, Arpaio noted that not only does he enforce the law, he also has his Cold Case Posse investigating Barack Obama’s birth certificate and eligibility.

Arpaio has scheduled a news conference March 1 in Phoenix to release the findings of the Cold Case Posse that has been investigating Obama’s eligibility.

The case Kevin Richard Powell v. Barack Obama and the other Georgia ballot challenge cases are different from all of the previous cases in that the judge DENIED Obama’s Motion to Dismiss. Therefore, this case cannot be compared to any of the previous cases because the merits of the case were presented in open court before Judge Michael Malihi. Subsequently, the FACTS with regard to Barack Obama’s “natural-born Citizen” status and non-compliance with Article 2 Section 1 Clause 5 of the U.S. Constitution as required for the Office of the President of the United States were entered into the court record. However, Obama ignored the subpoena requiring his attendance to the judicial proceeding where neither he nor his attorney even showed up and then his attorney sent an email directly to the Georgia Secretary of State asking him to just cancel the hearing, a move which is completely against the established “rules” of the court.

In an incomprehensible turn of events, Judge Malihi ultimately rewarded Obama’s astounding display of contempt for the court and his attempt to subvert the U.S. Constitution and “Rule of Law” by finding Obama eligible for the ballot even though he entered nothing into the record to prove his eligibility.

Pursuant to Georgia election law O.C.G.A. 21-2-5(a):

(a) Every candidate for federal and state office who is certified by the state executive committee of a political party or who files a notice of candidacy shall meet the constitutional and statutory qualifications for holding the office being sought.

Malihi relied upon a non-binding advisory opinion from an Indiana State case over a U.S. Supreme Court case which has held binding precedent since 1875 to “consider” Obama’s eligibility. In effect his recommendation would signify that the U.S. Constitution as he “considers” it would allow the child of a terrorist with dual allegiance to be President of the United States and Commander-in-Chief of the U.S. Armed Forces.

With great foresight and deliberate resolve, the Founders explicitly crafted the requirement of “natural-born Citizen” as a safeguard to guarantee protection for the nation against foreign influence.

The extant implications are so far-reaching they belie all reason and can’t be ignored. The foundations of our government made up of three equal branches have been totally undermined such that the Judiciary either can’t or won’t enforce the U.S. Constitution which is the “Law of the Land.”

The dangers posed to the Republic are profoundly grave. At best the Judiciary is of no effect upon an unchecked Executive branch, and at worst the Judiciary is complicit in the total destruction of the Constitution leaving tyranny in its wake.

This is not a theoretical exposition. While these United States are supposed to comprise a representative Republic, the fact remains Malevolent Forces have stolen the sanctity of the ballot to illegitimately usurp the highest seat of power with impunity while officials in positions of trust have turned a blind eye and abrogated their responsibility to support and defend the Constitution against all enemies both foreign AND DOMESTIC.

These enemies of freedom have plotted a course for the nation that will impact, if not control every aspect of your life against your will including your immutable God given rights.

We must challenge these Malevolent Forces girded by TRUTH and the armour of righteousness.

Barack Obama has not adequately proven that he was born a natural born citizen of the United States.

Under long-standing Supreme Court precedent [Minor v. Happersett, 88 U.S. 162 (1875)] the term “natural born Citizen” is defined as follows: “…(A)ll children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives, or natural-born citizens, as distinguished from aliens or foreigners...”

The precedent established under Minor v. Happersett has not been altered or superseded in the 137 years since it was handed down. It is established law and it applies to Barack Obama just as it does to every other citizen.

Barack Obama’s alleged father, Barack Obama, Sr., was never a citizen of the United States and, at the time of his son’s birth, was not a permanent resident of the United States.
Consequently, Barack Obama was born to only one parent who was a U.S. citizen or U.S. permanent resident.

In 1866, John A. Bingham, chief framer of the 14th Amendment, wrote as follows: “Every human being born within the United States of parents not owing allegiance to any foreign sovereignty (emphasis added) is, in the language of the Constitution itself, a natural born citizen.”

In order for Barack Obama to qualify as a “natural born Citizen,” it is necessary that both parents must have been U.S. citizens, either native born or naturalized, at the time of his birth.

By his own admission, and under the British Nationality Act of 1948, Barack Obama was born a citizen of the United Kingdom and Colonies, and from 1963 until at least 1984 was a citizen of the Republic of Kenya.

Barack Obama was born with dual US-British citizenship by descent from his Kenyan father and his American mother. Part 2, Section 5(1) of the British Nationality Act of 1948 reads, in part, as follows: “Subject to the provisions of this section, a person born after the commencement of this Act (Barack Obama, Jr.) shall be a citizen of the United Kingdom and Colonies by descent if his father (Obama, Sr.) is a citizen of the United Kingdom and Colonies at the time of the birth.”

Obama lost his dual US-British citizenship on December 12, 1963, the day on which Kenya won its independence from Great Britain. However, Chapter VI, Section 87[3] of the 1963 Kenyan Constitution provided as follows: “(1) Every person who, having been born in Kenya, is on 11th December, 1963 a citizen of the United Kingdom and Colonies (Barack Obama, Sr,)… shall become a citizen of Kenya on 12th December 1963… (2) Every person who, having been born outside Kenya, is on 11th December, 1963 a citizen of the United Kingdom and Colonies (Barack Obama, Jr.)… shall, if his father becomes, or would but for his death have become a citizen of Kenya by virtue of subsection (1), become a citizen of Kenya on 12th December, 1963.”

Obama held dual US-Kenyan citizenship from December 12, 1963 until August 4, 1984, his 23rd birthday. However, he became a Kenyan “citizen by birth” on August 4, 2010, the day on which Kenya adopted a revised constitution. Chapter 3, Section 14 of the 2010 constitution provides as follows: “A person is a citizen by birth if on the day of the person’s birth, whether or not the person is born in Kenya, either the mother or father of the person is a citizen (of Kenya).”

Due to his dual citizenship with the United Kingdom and with Kenya, Barack Obama was born with dual allegiances to foreign nations other than the United States of America.

The official U.S. government policy regarding dual citizenship is found in publications of the Consular Affairs Division of the U.S. Department of State, as follows:

“The concept of dual nationality means that a person is a citizen of two countries at the same time. Each country has its own citizenship laws based on its own policy. Persons may have dual nationality by automatic operation of different laws rather than by choice…

“The U.S. Government recognizes that dual nationality exists but does not encourage it… because of the problems it may cause. Claims of other countries on dual national U.S. citizens may conflict with U.S. law… However, dual nationals owe allegiance to both the United States and the foreign country. They are required to obey the laws of both countries (emphasis added)…”

One thing I’ve learned while researching my new, nearly finished book is that both history and news, history’s so-called rough draft, are not written by the “victors” as much as they are censored, twisted and reconfigured by what I can best describe as “the mob.”

I’m not referring to the Mafia. What I’m talking about is a mob-like amalgam of sharp elbows and big mouths who dictate acceptable topics, their narrative flow and an approved range of opinion – the consensus-makers. Defying consensus, breaking what amount to Mafia-like vows of “omerta” – silence – and delving into the verboten, is the worst possible crime of anti-mobness, punishable by eternal hooting and marginalization.

Few transgress. Which explains the news blackout on an extraordinary chain of recent events that took place in and around a Georgia courtroom and pertained to challenges to President Obama’s eligibility to be a presidential candidate in Georgia in 2012. In the end, the president defeated the challenge. He will be on the Georgia primary ballot come March. But therein lies an amazing tale.

Already I can feel the chill hiss of “birther” at the mere mention of these events, all because I haven’t included the mob-requisite catcalls that are “supposed” to go along with such accounts. But there’s nothing to mock here.

Last month, after Administrative Law Judge Michael Malihi denied motions by President Obama’s lawyer Michael Jablonski both to dismiss proceedings against the president and to quash a subpoena, three attorneys made history. For the first time, attorneys were permitted to enter evidence into the court record challenging Barack Obama’s constitutional eligibility to be president.

Georgia state law stipulates: “Every candidate for federal and state office … shall meet the constitutional and statutory qualifications for holding the office being sought.” Plaintiff attorneys Van Irion and Mark Hatfield, who is also a Georgia state representative, argued that President Obama, an American citizen, fails to meet these qualifications because he is not a “natural born” citizen, the constitutional requirement for the presidency. This is due, they argued, to the uncontested fact that his father, Barack Obama Sr. of Kenya, was a British subject, not an American citizen. A third plaintiff attorney, Orly Taitz – object of an eternity’s worth of “two-minute hates” within the media mob – introduced evidence that the 44th president of the United States has engaged in what appears to be identity fraud.

Such evidence, as gleaned from a partial list of exhibits introduced in the hearing and published at the American Thinker website, included affidavits from security professionals and other documentation attesting that Obama is using a Connecticut Social Security number (he never lived in Connecticut); that Obama’s purported Social Security number was never issued to him; and that – my favorite – his Social Security number “does not pass E-Verify.” Another affidavit from an Adobe Illustrator expert maintains that Obama’s birth certificate, released last spring to much hype and ballyhoo, is a computer-generated forgery.

The Obama Ballot Challenges: A Crisis of Confidence

Just a few months ago, FOX News reported on polling data which suggested that "[i]f Americans could cast a 'confidence' vote in the style of European parliaments, President Barack Obama would not fare well. A 56-percent majority would give his administration a vote of 'no confidence.'"

Ample evidence abounds for Americans to have no confidence that the economic justice activist-turned-politician is working out for the good of the country. Even at the most fundamental level, doubt remains as to whether the man occupying the White House is constitutionally eligible for the job.

There are two factors causing lingering doubts. The first is based upon Obama's secrecy in refusing to release relevant records for inspection and authentication. The second is that the Supreme Court needs to rule on the application of the Constitution's requirement, "natural born citizen," with respect to Barack Hussein Obama II.

Obama's bizarre secrecy

Numerous polls have confirmed that a significant number of Americans have doubts concerning the apparent birthplace of Obama. CBS News reported on April 21, 2011 that only one in four Americans believe that Obama was born in the United States.

After abruptly "releasing" an elusive birth certificate on April 27, 2011 (previously pronounced to be non-existent) -- after more than three years of stonewalling -- doubts still remain. Gallup reported that even after the infamous internet posting ceremony and sermon, those willing to say Obama was "definitely born in U.S." rose only nine percent, from 38 percent to 47 percent.

Recently, Public Policy Polling revealed that 51% of Republican primary voters have doubts over the venue of Obama's birth.

That's a sizable and entirely unnecessary problem.

Any doubt over presidential eligibility is unacceptable. The American people shouldn't have to "believe" that Obama is constitutionally eligible. Trust is for gods; skepticism and verification is for politicians.

The recent development of the state ballot challenges represents the right of the people to remove the doubt. Petitioners are demanding that evidence that meets the standard of courtroom admissibility, if it does exist, be produced to confirm Obama's eligibility.

If Obama is not willing to be completely transparent, then he should step down. To the bewilderment of his sycophants, the cloud of skepticism hanging over Obama's head is commensurate to his unique background, not his skin color. No one doubted the eligibility of Jesse Jackson, Alan Keyes, Al Sharpton, or Herman Cain.

Doubt remains because, legally speaking, Obama hasn't "released" anything. To meet a basic legal standard of evidentiary competence and admissibility, certified paper copies must be produced, and the original document in Hawaii must be made available for the states.

Rather than produce irrefutable evidence, Obama posted a "highly suspicious" image of a birth certificate on the internet.

Curiously (or maybe not so curiously), Obama refuses to produce certified copies and release the original for inspection and authentication. As with the case of the Certification of Live Birth document that the Daily Kos somehow obtained and posted online in 2008, Obama originals are reportedly inspected by "credible people" behind closed doors at the discretion of Obama.

The first factor causing doubt could be resolved immediately by Obama, if he were to have a conversion to transparency -- or if he could be forced to produce.

An Editorial

Following an August 18 meeting with members of the Surprise, AZ Tea Party, Sheriff Joe Arpaio announced that he had assigned an investigation into the presidential eligibility of Barack Obama to the privately-funded Cold Case Posse. Five of its most qualified investigators were tasked with leading the investigative work, and have been doing so in compliance with the highest standards of law enforcement investigation practices.

At the start of the process, it was estimated that their results would be released sometime after the first of the year; but, what should be understood is that law enforcement investigations simply take as long as they take. There is no way to predict exactly how long the compiling and processing of evidence will last, as leads tend to create additional leads, and they all take time to process properly.

Having communicated numerous times with sources very close to the investigation, I feel compelled to share some information from my perspective, as one who is not prohibited from commenting, since I am not a part of the actual investigation. Because of some misinformation that has been disseminated, I believe that Sheriff Joe and the Cold Case Posse deserve these clarifications of the record, as they are the only controlling legal authority that has stepped up to the plate for us in these matters. Out of gratitude for their willingness to offer their professional law enforcement experience, I believe it is important for the country to know the truth before the March 1st press conference.

As most people are likely aware, during a law enforcement investigation, those who are conducting it cannot reveal any of the evidence they are examining, as doing so can often hamper the investigation itself. However, there has been a concerted effort by someone playing the role of an attorney (very poorly, I might add) to either hijack or sabotage this investigation, as was evidenced by her mailing an unenforceable, downloaded “subpoena” form from Georgia's OSAH website. This was an attempt to “force” Sheriff Joe into prematurely revealing the products of his investigation, which, thankfully, was seen as the ignoble and ignorable act that it was. It was an attempted hijacking.

Being unsuccessful in hijacking the investigation, the next step was, predictably, sabotage. Very recently, she posted this statement on her website: I HOPE ARPAIO IS NOT USING HIS INVESTIGATION OF OBAMA AS A BARGAINING CHIP WITH THE FEDS. THIS WOULD EXPLAIN THE DELAYS.

Before proceeding, I want to explain something important, as this is crucial to understanding what is repeatedly happening to our initiatives. Orly Taitz seems to display a need to attach herself to every possible aspect of our movement in a tireless effort to remain the self-exalted face of it. When she is hampered in her quests to hijack what others are trying to accomplish (to try to claim their efforts as her own), she will inevitably do all she can to sabotage them.

We've seen this behavior exhibited countless times in her derisive attacks and libelous claims of those within our movement, such as her recent absurd assertion that Mara Zebest and Tom Harrison were “totally worthless,” and “their opinion is of no value,” when both had declined to participate in the joke that was her hearing in Atlanta (what she still erroneously refers to as a “trial”). Since Zebest and Harrison denied her the opportunity to hijack their professional opinions about their own analyses, they had to be decimated and discredited, for such a denial might tip others off to Orly's incompetence (as if Orly doesn't do enough of that on her own). Claiming others' work as her own is an effort to systematically exalt herself above everybody else in the movement.

This was also demonstrated in Taitz's involvement in the Georgia Ballot Challenge hearings. The basis of the first two hearings had been underway long before she ever injected herself into the proceedings; and, once she did, the other two lawyers did everything they could to separate their cases from hers—and even symbolically left the courtroom before her “case” was heard. Even Judge Malihi's findings made it clear that he perceived Taitz's case much differently than he did those of Irion and Hatfield; and it was evident that he wanted to publicize that understanding. However, it has been reported that Taitz was the “lead attorney in the cases” and was “responsible for the cases being heard.” Those were demonstrable lies.

Where Sheriff Joe fits into this picture is that, what he has done, and is doing, is something that is significant, and according to sources very close to the investigation, Orly has repeatedly tried to hijack his efforts; and there is no other reasonable explanation than her wanting to be able to claim those efforts as her own. Each of her attempts to weasel into the investigation has been shut down by the Cold Case Posse.

Well, all except one.

On October 25, 2011, there was a joint meeting of the Sun City West, AZ and Surprise, AZ Tea Parties at which there was a presentation scheduled by Sheriff Joe Arpaio. While I am told there was great vigilance in making sure the presentation did not get hijacked, those involved in that lookout detail were informed shortly before the meeting that Orly Taitz was flying in, and had arranged for her own videographer. Obviously, someone within the organization had leaked the information, and what ensued, once Sheriff Joe opened the door to questions from the audience, was an obvious attempt at the aforementioned hijacking.

We all need to understand that Sheriff Joe Arpaio has been in law enforcement for 51 years, and he doesn't need any help from Orly Taitz to conduct an investigation. Of course, the only help that Orly offers any initiative within our movement is the same kind of “help” that the late Dr. Jack Kevorkian offered the elderly. There is no person or organization that has poisoned our efforts more than Orly Taitz has.

"Please note that the foregoing cited errors, omissions, and flaws in Judge Malihi's "Decision" are not intended to be exhaustive, and Plaintiffs specifically reserve the right to raise other claims of error hereafter.

Mr. Secretary, as you deliberate on your final determination of Defendant Obama's qualifications to seek and hold office, I am requesting, on behalf of my clients, that you consider the posture of these matters. Defendant Obama has initiated the submission of his name as a candidate to be listed on the Georgia Democratic Presidential Ballot. Likewise, in accordance with their rights under Georgia law, my clients have raised a challenge to the Defendant's qualifications as a "natural born Citizen" pursuant to Article II of the United States Constitution. The Defendant and his lawyer tried, unsuccessfully, to have my clients' challenges dismissed. The Defendant was then legally served with a Notice to Produce, requiring him to appear at trial and to bring certain documents and items of evidence with him. The Defendant did not object. When the time for trial was imminent, the Defendant's lawyer wrote a letter to you in which he boldly criticized and attacked the judge and in which he stated that he and his client were refusing to come to court. The day of trial, after you warned him that his failure to appear would be at his own peril, the Defendant and his lawyer nevertheless failed to appear for court and failed to comply with the Plaintiffs' valid Notice to Produce. The Defendant thus not only presented no evidence of his own, but he failed to produce significant pieces of evidence to which Plaintiffs were legally entitled. Inexplicably, Judge Malihi, after verbally acknowledging Plaintiffs' entitlement to a "default judgment," then entered an order fully favorable to the recalcitrant Defendant, and to top it off, the judge refused to even acknowledge Plaintiffs' attempts to have Defendant held accountable for his purposefully contemptuous behavior in ignoring Plaintiffs' Notice to Produce.

Doesn't this result sound unreasonable? Doesn't this result appear on its face unfair? Doesn't this result in fact suggest that the Defendant is above the law?

Mr. Secretary, I am respectfully requesting on behalf of my clients that you render a decision in this matter that treats Defendant Obama no different than any other candidate seeking access to the Georgia ballot who fails and refuses to present evidence of his or her qualifications for holding office and who disregards the authority of our judiciary. I request that my clients' challenges to Defendant Obama's qualifications be sustained and upheld.

Finally, in view of the rapidly approaching Presidential Preference Primary in Georgia on March 6, 2012, I respectfully request that you enter a decision in these matters on an expedited basis."

Following a Georgia judge’s ruling that Barack Obama is eligible to be on the state’s 2012 Democratic Party presidential ballot, the front lines in the continuing eligibility battle are being fought in Arizona.

Maricopa County Sheriff Joe Arpaio told WND today his office has scheduled a news conference in Phoenix for March 1 to release findings of the Cold Case Posse that has been investigating Barack Obama’s birth certificate and eligibility to be president.

Arpaio declined to release to WND any of the posse’s conclusions in advance of the press conference, although he is on record saying the findings may be “shocking” to many.

In a separate matter, Arpaio told WND that a group of Department of Justice officials from Washington, D.C., began meeting with officials of the Maricopa County Sheriff’s Office regarding the DOJ’s allegation of systematic violations of the federal civil rights of Hispanics.

If the negotiations fail, the DOJ has threatened to take Arpaio and the MCSO to federal court, setting up an epic political battle just as Arpaio prepares to issue the results of the Cold Case Posse’s investigation.

Arpaio’s decision to investigate Obama follows a meeting held in his office Aug. 17 with tea party representatives from Surprise, Ariz., who presented a petition signed by more than 250 Maricopa County residents. The petitioners expressed concern that their voting rights could be irreparably compromised if Obama uses a forged birth certificate to be placed on the 2012 presidential ballot in Arizona or otherwise is found to be ineligible.

WND previously reported that the tea party letter formally stated the following charge: “The Surprise Tea Party is concerned that no law enforcement agency or other duly constituted government agency has conducted an investigation into the Obama birth certificate to determine if it is in fact an authentic copy of 1961 birth records on file for Barack Obama at the Hawaii Department of Health in Honolulu, or whether it, or they are forgeries.”

The posse, constituted under the authority of Arpaio’s office, consists of three former law enforcement officers and two retired attorneys with law enforcement experience. It has been examining evidence since September concerning Obama’s eligibility to be president under Article 2, Section 1 of the Constitution.

ATLANTA … Georgia Secretary of State Cathy Cox today ruled that House District 29 candidate Randy Sauder will remain on the ballot as a Democratic candidate in the 2000 General Primary and General Elections. In an order signed today Ms. Cox ruled against a challenge to Rep. Sauder’s candidacy brought by petitioner Marston H. Tuck.

Secretary of State Cox rejected state administrative law judge (ALJ) Michael Malihi’s initial decision in the Sauder matter, which procedurally serves as a recommendation to Secretary Cox, the state’s chief elections official. Ms. Cox found flawed the ALJ’s interpretation of Georgia election law governing the qualification process for candidates, and endorsed the opinion and guidance of Georgia Attorney General Thurbert Baker. Attorney General Baker has opined that it is legal and permissible for a candidate to, during the period in which candidates submit documents to their political parties, withdraw their Declaration of Candidacy with one political party and re-submit it with another.

Mr. Tuck challenged Mr. Sauder’s qualifications based upon the claim that once he had submitted qualifying documents with the Republican Party he could not legally submit them with the Democratic Party, even though Mr. Sauder had taken the appropriate legal steps to formally withdraw his Republican candidacy.

Ms. Cox noted that the Sauder challenge was a complex one involving differing interpretations of state election law and procedure. “While it is unusual to not accept the initial decision of an ALJ, it would be unprecedented for this office to reject the guidance of the Attorney General, who both provides us legal guidance and would serve as our counsel should this matter enter litigation,” she added.

In her order, Secretary Cox addressed the distinction between the filing of papers and fees and the formal conclusion of the qualifying process: “It defies logic, law and practice to conclude that the mere filing of papers and appropriate fees concludes the ‘qualification’ by a candidate…There simply are no qualified candidates, in theory or in practice, until the political parties submit a certification of qualified candidates within three days after the qualifying period closes, O.C.G.A. 21-2-154, and to conclude otherwise would wreak havoc on the elections system.”

Secretary Cox in her order noted that the relevant provision in Georgia election law was enacted following the 1974 race for Governor, in which former Macon Mayor Ronnie Thompson qualified and ran both as a Democratic and Republican candidate for that office, a form of candidate “double dipping.”

Under Georgia law a party to a candidate challenge may appeal the Secretary of State’s decision in Fulton Superior Court.

TOPEKA, KS (KCTV) - A Kansas board that denied a licensed doctor of osteopathic medicine a license was primarily concerned about the man's political views.

The Kansas State Board of Healing Arts is a 15-member panel appointed by the governor and decides the fate of doctors in Kansas.

Terrence Lee Lakin rose to the ranks of lieutenant colonel in the U.S. Army. He served on the front lines in Afghanistan and the war zone in Bosnia as well as a medical mission to Honduras. He saved lives around the world and received a Bronze Star for his service.

"I like helping people," said Lakin. "And I've been, since college wanting to be in medical field and help others."

But a dispute over whether President Barack Obama was born in the United States led to Lakin being forced from the military and apparently led to the Kansas board in October denying him a medical license to practice in the Sunflower State.

The board repeatedly refused comment on their decision, but a transcript of Lakin's shows board members didn't concern themselves with Lakin's 18-year spotless medical record.

"They hammered me for my political views," said Lakin. -----

----- KCTV5's investigation reveals that in 2008, the KSBHA board approved the license of another doctor with a history of medical mistakes and malpractice payouts. One patient died after a drill mishap in the operating room. A surgical error caused repeated electrical shocks to a second patient. And a third patient wasn't even that doctor's patient. The physician didn't notice, ended up performing brain surgery on the wrong man and caused permanent damage.

The board refused our repeated requests for an interview about the decisions it makes and the seeming disparity of these two cases. A renowned University of Pennsylvania medical ethicist, Art Caplan, agreed to weigh in on the situation.

"Political beliefs, I think, should play no role," said Caplan. "Is it going to be a popularity contest that decides what political views you can have as a doctor? Or is it going to be the majority views that decides what political views you can have? Obviously, again - I don't think this is relevant to who practices well."

Lakin agrees with Caplan. "I knew medical boards had a bad reputation. I had hoped this issue would have nothing to do with my practice."

Lakin's only recourse now is a judicial appeal, but he's uncertain that he can afford the costs. He has a book coming out this month detailing his experiences.

Atty. Van Irion to Appeal Judge Malihi's Decision: Court Ignored Basic Rules of Interpretation

Georgia Court Ignored Basic Rules of Interpretation

By now many of you have probably heard that the Georgia court ruled that Obama is a natural born citizen. (Link to opinion) More importantly it ruled that any person born on U.S. soil is a natural born citizen. According to the Georgia court, a woman from any country can visit the U.S. for one day, give birth, take the baby back to any country to be raised under any culture, and that baby can return as an adult, live here for 14 years and run for President. The end result of this ruling is outrageous. It runs contrary to common sense as well as to established law.

So, what happened in Georgia? The court determined that a clear definition of natural born citizen from Supreme Court precedent was overturned by dicta in another Supreme Court case. Precedent is any statement by the court that is pivotal to reaching the court’s ruling. Dicta is the opposite of precedent. Dicta is a statement by the court about matters that are not pivotal to reaching its ruling. Dicta is persuasive, but it cannot overturn precedent.

In other words, the Georgia court violated a basic rule of legal interpretation by ruling as it did. But wait, there’s more! The Georgia court also violated rules of Constitutional interpretation that have been around since the earliest Supreme Court. Our first Chief Justice explained that no part of the Constitution should be interpreted in a way that leaves any other part of the Constitution without independent meaning. By ruling that anyone born on U.S. soil can run for President the Georgia court concluded that the 14th Amendment was intended to alter article II of the Constitution. Such an interpretation is 180 degrees in opposite to Chief Justice Marshall’s explanation of how to interpret the Constitution.

But WAIT, there’s more! In order to reach this conclusion the Georgia court ALSO had to disregard yet another part of the holding from the Minor v. Happersett Supreme Court ruling. Even if you ignore the rules of Constitutional construction and the rule that dicta can’t overturn precedent, even if you agree with the Georgia court that the definition of natural born citizen in the Minor decision was dicta, you still can’t reach the Georgia court’s ruling. You see, the Minor Court ALSO explicitly ruled that the 14th Amendment didn’t create any new privileges and immunities. So, if a person couldn’t run for President before the 14th Amendment, they couldn’t run for President after the 14th Amendment. This means that the Minor Court explicitly ruled that the 14th amendment didn’t alter the definition of natural born citizen under article II of the Constitution. Yet the Georgia court ignored this Supreme Court ruling as well.

The Georgia court was aware of all of these arguments because these arguments were made at the January 26 hearing and they were included in our written brief after the hearing. Yet the Georgia court’s ruling only addresses one of these three arguments and poorly at that.

The one point of good news from this ruling is that we have FINALLY gotten a court to rule on the merits of our argument. This may seem like a hollow victory, but it isn’t. Before this everyone that has brought a challenge against Obama’s eligibility has been dismissed on procedural grounds. Nothing is more devastating to the rule of law than a judicial branch that refuses to do its job. Before this case we had courts across the country telling Americans that they had no right to enforce the Constitution. That was absurdity at its most extreme. Liberty Legal Foundation found a case that we believed would at least get a ruling on the merits. We hate the ruling we got, but at least we got a ruling. Now we can appeal that ruling. The appeals process now will focus on the definition of "natural born citizen" rather than procedure for the first time since the issue of Obama's eligibility was raise in 2008.

For all the reasons I’ve mentioned in this message, we will be appealing the Georgia Court’s ruling. We will continue to fight for Constitutional rule of law. Failing that we will continue to force Courts to show their true colors. If our judicial branch will not uphold the rule of law, that fact needs to be exposed to the harsh light of day for all the world to see.

Attorney Mario Apuzzo Obliterates Judge Malihi's Ruling Based on Flawed Ankeny Opinion

All That Is Wrong with Georgia State Judge Michael M. Malihi’s Decision

that Putative President Obama Is a “Natural Born Citizen”

Georgia State Administrative Law Judge, Michael M. Malihi, issued his decision on Friday, February 3, 2012, finding that putative President, Barack Obama, is eligible as a candidate for the presidential primary election under O.C.G.A. Sec. 21-2-5(b). I must enter my objection to this decision which is not supported by either fact or law.

The Court held: “For purposes of this analysis, this Court considered that President Barack Obama was born in the United States. Therefore, as discussed in Arkeny [sic meant Ankeny], he became a citizen at birth and is a natural born citizen.”

But there is no evidence before the Court that Obama was born in the United States. The court can only rest its finding of fact on evidence that is part of the court record. The judge tells us that he decided the merits of the plaintiffs’ claims. But he does not tell us in his decision what evidence he relied upon to “consider[]” that Obama was born in the United States. The judge “considered” that Obama was born in the United States. What does “considered” mean? Clearly, it is not enough for a court to consider evidence or law. It must make a finding after having considered facts and law. The judge simply does not commit to any finding as to where Obama was born. Using the word “considered” is a cop out from actually addressing the issue. Additionally, we know from his decision that neither Obama nor his attorney appeared at the hearing let alone introduced any evidence of Obama’s place of birth. We also know from the decision that the judge ruled that plaintiffs’ documents introduced into evidence were “of little, if any, probative value, and thus wholly insufficient to support Plaintiff’s allegations.” Surely, the court did not use those “insufficient” documents as evidence of Obama’s place of birth. Nor does the judge tell us that he used those documents for any such purpose. The judge also does not tell us that the court took any judicial notice of any evidence (not to imply that it could). The judge did find that Obama has been certified by the state executive committee of a political party. But with the rules of evidence of superior court applying, this finding does not establish anyone’s place of birth. Hence, what evidence did the judge have to rule that Obama is born in the United States? The answer is none.

The court did not engage in its own thoughtful and reasoned analysis of the meaning of an Article II “natural born Citizen,” but rather relied only upon Ankeny v. Governor of the State of Indiana, 916 N.E.2d 678 (Ind. Ct.App. 2009), transfer denied, 929 N.E.2d 789 (2010), a state-court decision which erred in how it defined a “natural born Citizen.”

The court says that Ankeny is persuasive. The court does not show us why Ankeny is persuasive other than to just provide some quotations from the decision. On the contrary, upon close analysis, we can see that Ankeny is far from persuasive on the definition of a “natural born Citizen.” The court’s decision can only be as sound as the Ankeny decision may be. But an analysis of that decision shows that it was incorrectly decided as to its definition of an Article II “natural born Citizen.”

Presidential eligibility is a national issue. Under our Constitution, like the States do not have power to naturalize citizens, they also do not have power to change, add, or diminish the meaning of an Article II “natural born Citizen.” See U.S. Term Limits, Inc. v. Thornton, 514 U.S. 779 (1995) (states have no authority to change, add, or diminish the eligibility requirements for members of Congress). Moreover, as naturalization needs uniformity, so does the citizenship standard needed to be met by those wishing to be eligible to be President. Hence, any state court decision on the meaning of a “natural born Citizen” is not binding on the nation in determining who is eligible to be President. Such a decision can only be ultimately made by the U.S. Supreme Court which would make its decision the law of the entire nation. The Ankeny case is a decision of the Indiana state court and not by the U.S. Supreme Court. For this reason, the Ankeny decision is not binding on any court deciding the question of what is a “natural born Citizen.” But not only is the decision not binding, it also needs to be rejected for diminishing the meaning of an Article II “natural born Citizen.”

Apart from the Ankeny decision not being binding on the national issue of what is a “natural born Citizen,” the decision itself should be rejected on its merits.

The Constitution’s text does not define a “natural born Citizen.” Yet, Ankeny did not even discuss what the Founders’ and Framers” original intent was in including the “natural born” Citizen clause in the Constitution. It is a rule of constitutional construction that we can learn what the Founders and Framers intended by a certain term they included in the Constitution by discovering what their purpose was for including the term in that document. But the Ankeny court told us what an Article II “natural born Citizen” is without examining the purpose for which the Founders and Framers included that clause in Article II, Section 1. No where in the decision do we see that the court examined what the Founders’ and Framers’ intent was for inserting the clause in the Constitution. The court conducted no independent historical research or analysis regarding what the Founders and Framers intended when they wrote the “natural born Citizen” clause in the Constitution in 1787. In fact, no where in the decision did the court even raise the issue of the Founders’ and Framers’ intent when they wrote the clause in Article II. It provided no sources from the Founding period which in any way supports its holding. It discussed no historical records or declarations of historical figures. So its decision as to what a “natural born” Citizen is has no historical or legal support.

The Founders and Framers placed their trust in “the Laws of Nature and of Nature’s God.” The Declaration of Independence, para. 1. They came to learn what natural law was from studying ancient history and its influence in the then modern world. They knew from studying this history and the great publicists, including Emer de Vattel who was the Founders’ and Framers’ favorite, that natural law became the law of nations. And Vattel in Section 212 of his The Law of Nations (London 1797) (1st ed. Neuchatel 1758) defined what a “natural born Citizen” is. There he said that the “natives, or natural-born citizens, are those born in the country, of parents who are citizens.” The Indiana state court in Ankeny did not even discuss natural law and the law of nations. The Ankeny court just barely acknowledged Emer de Vattel. It refers to Vattel's highly influential work, The Law of Nations, as "an eighteenth century treatise" and discusses neither Vattel nor his work. Hence, it fails to understand the importance of the law of nations and Vattel to the Founders and Framers and in the founding of our nation and their drafting of our Constitution in which they included the law of nations and not the English common law as part of Article III "Laws of the United States." The court hardly knew who Emer de Vattel was. This should be an indication to anyone who has seriously studied the Obama eligibility issue of how much reliance we can place on the court’s ruling as to what a “natural born Citizen” is.

Judge Malihi also did not discuss the early naturalization statutes passed by our early Congresses. These acts are critical in understanding the definition of a “natural born Citizen” because so many members of the early Congresses were Founders and Framers. “The significance of such a statute passed by the first Congress was, of course, the fact that many of the framers of the Constitution were Members of that first Congress, as well as the fact that the first Congress’s understanding of the meaning of the terms of the Constitution was most contemporaneous in time with the document’s adoption. One author has noted that of the “Committee of Eleven,” which first proposed to the Convention of 1787 the eligibility requirement of being a “natural born” citizen, 8 of the 11 committee members were in that first Congress, and none stated objections to or disagreement with the characterization of the term “natural born” by statute by the Congress.” Christina Lohman, Presidential Eligibility: The Meaning of the Natural-Born Citizen Clause, 36 Gonzaga Law Review 349, 371 (2000/2001). The Naturalization Acts of 1790, 1795, and 1802, prove that only a child born in the United States to U.S. citizen parents can be an Article II “natural born Citizen.” These acts treated children born in the United States to alien parents as aliens themselves. These acts also naturalized children born abroad to U.S. citizen parents to be in 1790 “natural born citizens” and then in 1795 and thereafter “citizens of the United States.” By analyzing these acts, we can see that the only child over whom Congress did not exercise its naturalization power was a child born in the United States to citizen parents. Hence, that child was the “natural born citizen.”

Ankeny misread Minor v. Happersett, 88 U.S. 162 (1875), saying that the Minor Court read Article II and the Fourteenth Amendment "in tandem," suggesting without any support that the latter somehow amended the former. It also erred when it said that Minor "left open the issue of whether a person who is born within the United States of alien parents is considered a natural born citizen." The Court did no such thing. Rather, the Court left open that question as it applies to a Fourteenth Amendment born "citizen of the United States," not an Article II "natural born Citizen." Minor told us that there is no doubt who a “natural born Citizen” is, telling us that it is a child born in the country of two U.S. citizen parents. That definition is based on natural law and the law of nations and not the English common law. Indeed, this confirms that the Founders and Framers gave us only one citizenship definition to be used to determine eligibility to be President. On the other hand, Minor added that there is doubt as to whether a child born in the U.S. to alien parents was even a “citizen.” The Framers gave Congress the power to make future “citizens of the United States” through naturalization. Hence, the doubts have been over the definition making persons the parents of a future “natural born Citizen,” not over the definition making the child of those parents a “natural born Citizen.” It also confounded Minor and U.S. v. Wong Kim Ark, 169 U.S. 649 (1898) as relying upon the English common law to define a “citizen” and a “natural born Citizen.” It said that Minor relied upon the English common law like Wong Kim Ark did when it did not do any such thing, for it relied upon natural law and the law of nations which when applied in the United States became “common-law” (the language that Minor used), which given the definition of a “natural-born citizen” that the Court provided (including the citizenship of the parents as a condition of being a “natural-born citizen”) could not have been English common law but rather was American common law. In order to justify its decision, Ankeny gave authority and respect to the feudal English common law (per Lord Coke and Lord Chief Justice Cockburn) on matters of U.S. citizenship and gave no such authority and respect to our own American common law which Minor showed replaced that feudal law in the new republic. In fact, there is not one word in the Minor decision which sounds in the language of the English common law, yet Ankeny said that it relied upon English common law. It distinguished Minor in footnote 12 by saying that it “contemplates only scenarios where both parents are either citizens or aliens, rather in the case of President Obama, whose mother was a U.S. citizen and father was a citizen of the United Kingdom.” But it did not explain how or why having one U.S. citizen parent rather than none would make any difference when applying the “natural born” Citizen clause.

As you know we were expecting word out of Georgia today and we got it. Late this afternoon Judge Malihi issued his ruling against all four Plaintiffs.

We caught up with Swensson/Powell's counsel, Mark Hatfield, late this afternoon to get his initial take on the ruling. Here is what he stated “obviously we are disappointed w/the decision, but there are a couple of items in the ruling that we are looking at. First, the Judge never made any ruling on who has the burden of proof even though he indicated in chambers prior to the hearing that making the determination of the burden of proof laid with Defendant Obama." He went onto state "the Judge has a record of placing the burden on the candidate, but didn't do so in this case." Another point Hatfield made was the “Indiana Court of Appeals ruling in Arkeny elevates the Indiana case above the Constitution" while also noting the Judge ignored the Minor court in Minor v Happersett, a ruling that clearly defined natural born Citizen, established precedent. When asked about next steps Hatfield stated "we are going full bore and taking it up on appeal”.

We just spoke with plaintiff Kevin Powell and he reports Judge Malihi has ruled against the Plaintiffs and stated in his order that Obama was born in Hawaii and therefore Obama is a natural born Citizen.

UPDATE: Judge: Obama eligible to be Georgia candidate

A state administrative law judge on Friday flatly rejected challenges seeking to keep President Barack Obama from being a candidate in next month's Georgia primary.

In a 10-page order, Judge Michael Malihi dismissed one challenge that contended Obama has maintained a Hawaiian birth certificate that is a computer-generated forgery, has a fraudulent Social Security number and invalid U.S. identification papers. He also turned back another that claimed the president is not a natural born citizen.

Last month, Malihi heard testimony and took evidence in a hearing boycotted by Obama's lawyer.

With regard to the challenge that Obama does not have legitimate birth and identification documents, Malihi said he found the testimony presented by lawyers of the so-called "birther" movement and their evidence "to be of little, if any, probative value and thus wholly insufficient to support plaintiffs' allegations."

A number of the witnesses who testified about the alleged fraud were never qualified as experts in birth records, forged documents and document manipulation, Malihi wrote. "None of the testifying witnesses provided persuasive testimony," he wrote.
